According to sources with the Muscle Shoals Police Department, the Brooks High graduate provided the tip that led searchers to the area off Gnat Pond Road where the body of Weems' victim, Amanda Leeth Taylor, lay partially hidden.

Greenhill has yet to be charged in the crime, but authorities are not ruling out more arrests. Other sources outside the police department have stated Greenhill, sometime girlfriend of Ron Weems, is the link between Weems and Matthew Fox who has also been arrested in the heinous killing.

Several have asked why Ashley Greenhill, aka Ash Lette, was not arrested as an accessory after the fact, especially since both Laurel Pruett and Matthew Fox were. For whatever reason, aspiring model Greenhill had become concerned that Amanda's body would be found, or that someone, possibly Fox, would go to the police. She decided to cut a deal with the authorities, stressing that she had heard about the killing only accidentally. Our sources say the three defendants will dispute Greenhill's version of the events, but it remains to be seen if she will be charged.

We have to ask how the participants in this mangy menage found each other. We know Laurel Pruett was so desperately in love with Ron Weems that she wouldn't let him go, even knowing the worst. Was Matt Fox similarly enthralled by Ashley Greenhill? If any of these cases comes to trial, it will obviously be standing room only.

Just who is Ashley? She has quite a history.

By the time Ashley Fawn Greenhill met Clint Matthew Anderson, she had a child and he had a felony conviction. Together they lived on the north end of Howell Street in a bungalow that had seen better days.

Pregnant with Clint's child, Ashley had given guardianship of her two year-old son to her parents, but sometimes brought the child into the home she shared with her then boyfriend. After one such visit, Ashley's parents noticed bite marks over much of the boy's body, along with scratches over his lower back and extremities. The Greenhills immediately reported the child's condition to DHR, and both Ashley and Clint were arrested.

At the time of Ashley Greenhill's arrest for Felony Torture of her child, she was out of jail on bail for charges of burglary, theft, criminal mischief and receiving stolen property. Her bail revoked, the 21 year-old Ashley agreed to enter drug rehab and was given leniency by the courts. Clint's parole was revoked, and he was returned to the Alabama Department of Corrections where he remains incarcerated at a facility called the Cattle Ranch. He's scheduled to be released on September 9, 2014.

By the fall of 2011, Ashley was 24 and enrolled in classes at NWSCC studying to be a hair dresser. Her online profiles describe her as a model, but acquaintances stated she worked as a stripper. The portrait to the left was posted online ten days before the murder of Amanda Taylor. On the networking site, Ashley has one contact--"Rob Noxious."

Needing a home, Ashley asked fellow Insane Clown Posse groupie Ron Weems for a place to stay. Weems allowed the young woman to move into the Muscle Shoals home he shared with his widowed mother, but later commented on Facebook that Ashley was a "roach" who had brought other vermin into his house. Whether he referred to Matthew Fox, we may only surmise.

By now Laurel Pruett, the mother of Ron Weems' four year-old daughter, had moved into a home in Sheffield. While Laurel was a frequent visitor to the Moss Avenue home she once shared with Ron, friends have said theirs was an open relationship and many believed him to be involved sexually with Ashley.

At around 3:00 p.m. on October 17th, Robert D. Lee arrived at the home of Ronald Weems to pick up Amanda Taylor. Ashley Greenhill, aka Ash Lette, was sitting on the front porch with Ron's mother Laquania Welch Weems. In her hand was a hatchet that she began to wave over her head in a threatening manner. Greenhill told Lee that sometime after Taylor arrived at the Moss Avenue home around 1:20, she had attacked Ronald Eugene Weems and was no longer at the residence. Lee, fearful for his safety, left the premises. It's good to know Ashley's Juggalo props can pull double duty.

On November 7th, Ashley Greenhill reported to police that she had overheard several phone conversations in which Weems and Laurel Pruett discussed the murder of Taylor and the subsequent disposition of her body. Greenhill stated she was in fear of her life and had shortly thereafter moved out of the Muscle Shoals home she was sharing with the Weems family. Ronald Weems then made his enigmatic Facebook posting in which he called Greenhill a "roach."

Matthew Richard Fox & Co-Worker

According to Laurel Pruett's confession, Ashley Greenhill and her friend Matthew Richard Fox joined Weems and her in the basement of the Moss Avneue home around 10:30 p.m. on the night of the murder. A friend of Fox, aka Fox Fudoshin, has stated Ashley Greenhill texted Fox and asked for information on the best way to hide a body. Fox had ostensibly never met Weems before that night, and Greenhill was the only link between them. We're going to assume Fox now wishes he had never met Ashley Greenhill.

Other sources have stated that after Greenhill looked at Amanda's corpse, she walked upstairs to smoke weed and take Valium while waiting for the safety of nightfall. Fox's friend and co-worker Luke Stanfield stated he has known Ashley Greenhill for approximately ten years and has never known her to be a truthful person. We may infer Stanfield's opinion is correct since she certainly offered several colorful tales to explain the injuries she and her boyfriend inflicted on her then two year-old son.

Yet, Ashley Fawn Greenhill is not in jail with her friends. We have to ask why. What kind of deal was the Brooks High grad offered? Life isn't fair, and neither is death. The enormity of this gruesome murder is mind boggling. If Greenhill isn't prosecuted for this crime, the would-be model will undoubtedly be prosecuted for something else down the road.

Kenneth Dyar Wood: Man of God or Rapist?

The following is taken from Shoalanda Speaks dated May 2, 2009, and October 8, 2011.

Kenneth Dyar Wood is a 70 year-old Pentecostal minister, the father of three daughters, and an accused child rapist. Currently, Wood is being held in the Morgan County Jail with bond set at $70,000.00. According to Morgan County Sheriff Gene Mitchell, the Speake resident has been the subject of a two-month investigation that culminated with his arrest for the rape of a child under the age of twelve.

Specifically, Wood is charged with raping an eleven year-old Colbert County girl at his home in December 2008. During the investigation, two other girls stated that Wood had sexually molested them. According to investigators, more girls and young women have indicated they will now come forward and further charges are likely.

The Barnett Chapel Pentecostal Church where the accused rapist had served as pulpit minister for several years has publicly announced that Wood resigned as of last Sunday. Officials there refused further comment.

Obviously, we will hope no one previously knew of this man's deviant behavior. Married to 68 year-old former Wanda Marie Gillespie, Wood is the father of 42 year-old Tracy Marie Wood HIcks, 38 year-old Wendy Scarlett Wood, and 34 year-old Shelly Kenya Wood. Certainly his church must have seen him as a God-fearing family man who could be trusted with the children of the congregation. Yet, over 13% of religious leaders have admitted to having sex with congregants, consensual and otherwise.

Sadly, the next few days and weeks will reveal the scope of Kenneth Dyar Wood's deviance. It won't be a pretty picture.

*****

The wheels of justice frequently turn slowly; therefore we are never surprised at the length of time between an arrest and indictment, or between an indictment and the actual plea or trial. A reader has sent us a link to an obituary for Wood.

It seems that after being arrested in May 2009 on at least one count of rape of a child under the age of 12, Kenneth Dyar Wood reported to a higher judge than the one he would have faced in Lawrence County. The Pentecostal preacher passed away on May 28, 2010, and was buried June 2nd at Morris Chapel Cemetery. The 71 year-old Wood had possibly faced more charges as other victims were reported to be coming forward.

If Wood was innocent, it's sad that he did not have a chance to redeem his reputation. If guilty, at least his victims and their families know they are now safe from the pedophile who robbed them of so much.

More Crime Blogs

All crime is different, but every reader should find something to their taste in one of these. font-family: arial;">All my life I've been surrounded by people who volunteer to improve the community. I've always worked with various well-established school clubs and when I volunteered to work with Sweetwater Mansion, I expected it to be the same. I couldn't have been more wrong.

My first day as a volunteer was in the middle of August, and the director immediately handed me a camera and told me to take photos inside the house and on the grounds. Cynthia Johnson told me she was specifically looking for orbs that would suggest a ghostly presence. I do believe in ghosts, but I had volunteered to help restore the mansion, not take snapshots of what Ms. Johnson wanted to prove was on the property.

Nevertheless, I followed her instructions, and several of us volunteers took photos for Cynthia. After we finished up, Cynthia told one young man he had captured the image of a werewolf in his photos. She then proceeded to show off what she called her psychic powers by offering predictions to our group. My friends and I thought the whole set up was odd, but we believed that the director really cared about the house so her behavior didn't bother us that much at the time.

When we returned in October to begin the tours, we found that absolutely nothing had been done to restore the old home. These things take time and money, so we told ourselves "Rome wasn't built in a day." Cynthia told us that restoration would begin in earnest in early December, and we still had no real reason to doubt her.

As Cynthia began to tell us about the history of the house, she mentioned she had been William McDonald's personal assistant at one time. We found this impressive, but then she continued to tell us about Susan Leigh Smithson, the property's owner. According to Cynthia, Ms. Smithson had been a high fashion model in her younger days and was now a fashion designer. I consider myself pretty fashion savvy and had never heard of Ms. Smithson, so I decided to Google her when I returned home. I found that Susan owned a shop in Atlanta that specialized in prom dresses and she had some odd comments and reviews attached to her name.

Things definitely weren't adding up. I was left to wonder just what other statements we needed to take with a grain of salt...

Sweetwater's director Cynthia Johnson liked to paint a perfect picture of the supposedly wealthy owner. She never spoke of Susan Smithson without mentioning her great wealth, but by October of 2010, we began considering the source. We soon saw that Susan didn't pay for anything related to the house. Her mother Edith Smithson paid the bills, and we also soon learned that the money earned from any events was paid directly to Susan's mother.

At first I thought this looked shady, but Cynthia said Mrs. Smithson paid the utilities and taxes for Susan. When I asked Cynthia why the plantation hadn't received tax exempt status, she told me she had sent the paperwork to Susan's mother who had lost it. I didn't ask after that.

I did talk with two other volunteers who had similar stories about the finances at the mansion, but there was never a great deal of money involved. I would guesstimate less than four thousand was taken in each year the mansion was open to the public. Still, we thought this money should have gone to restoration rather than to pay Susan's electric or tax bill. We began to think the mansion would never be restored with Cynthia as director.

As the tours took shape, Cynthia told us stories of the original land owner, Gen. John Brahan, practicing voodoo in the basement and other ghost tales which she seemed to relish. About this time I became friends with another local historian who worked there. She shared her knowledge of Mr. McDonald's history of Sweetwater and also many things she had discovered through her own research. She was in possession of some writings of Jane Patton and other first hand material from that era. The two stories were so different, and Cynthia's was so unbelievable.

I began to use the story told to me by my friend when I lead the tours, rather than the more lurid voodoo story that Cynthia had told me to relate. Cynthia then began to follow me around during the tours and "correct" me. I was becoming more and more disenchanted, but Cynthia told me in late October that massive restoration work was set to begin in early December.

I knew that Cynthia had promised this before, but I hoped this time it was true. When I returned to the home after Christmas break, again absolutely nothing had been done. It was then that I decided to call owner Susan Leigh Smithson...

I looked up the number for Miz Scarletts in Atlanta, called, and asked to speak to Susan. I was told Susan was at fashion week in Paris. This was early in January, and I knew the only shows in Paris at that time were haute couture and men's fashion. What prom dress store owner would be invited to something like that? I started laughing, but I did manage to say I worked at Sweetwater and gave them a false name.

Apparently I still gave store personnel too much information because it was only about five minutes later that Cynthia Johnson called me. It seems Susan had called her and was livid. How had I found her "private number?" She related that Susan didn't take calls because she got death threats, was involved in lawsuits, and the list just went on an on. I don't know what any of Susan's personal problems had to do with me, but if I had problems with Cynthia before, I really had them now.

She began telling other volunteers that I was out to get her and wanted her "job." At first I just shook it off, but then something happened that I couldn't just overlook. Cynthia was always relating things using her self-proclaimed psychic abilities, but now she began to tell others that she had a vision of me in the future and in this vision I was being raped.

When I heard this I was angry beyond words; I was sick to my stomach. When I confronted Cynthia she told me she was only concerned for my well being. Apparently she wasn't concerned enough to come to me privately and tell me this. What should I do? I didn't want to be around Cynthia any more, but I really loved Sweetwater, so I decided to stay at least until the Living History Days in April.

I wanted to be sure the stories told during the program were accurate, but Cynthia had her own version of things leading up to the actual event. If anyone ever asked about Susan, Cynthia told them that Smithson was in London working on Kate Middleton's dress for the royal wedding. I wish I could say she was joking, but she was completely serious. If this didn't kill any interest I had in the project, what happened next did.

Things actually went very well for the living history event, and some of us decided to spend the night at Sweetwater. There were only volunteers present, and we were having fun playing with some of the ghost hunting equipment. At least it was fun until two to the committee members got into an argument that turned nasty very quickly.

One of the two involved was my friend who had helped me with Sweetwater's history. She resigned the next morning and most of us were extremely upset. We thought that Cynthia Johnson as director should do something about it. Instead, Cynthia acted as if nothing odd or out of the way had happened. I then decided to distance myself from the project, only dropping by if someone I knew well was going to be there.

Some time later I received a phone call from this friend who had been "thrown under the bus." She had heard that someone was taking up money for Sweetwater at First Fridays and asked that I go with her to the next event and see what we could find out. Before we could go, I heard that Cynthia was accusing me and still another former committee member of being the ones who were collecting the funds. I decided to call Cynthia to ask why she was accusing us. She told me she had received a description of the pair and they sounded much like my male friend and me.

I still love Sweetwater and want it to be restored. I don't know what it will take, but I honestly and sincerely believe that Cynthia Johnson is holding the project back. Volunteers don't stay long and no real work is ever done. If exposing what is really going on at Sweetwater will help, I feel that I have finally accomplished something.

Originally published in Shoalanda Speaks July 28-August 1, 2011.

The Saga of the Reedtown Rapist

The Franklin County community of Reedtown is an anachronism, a racially segregated town that sits at the southwest corner of Russellville. Known for its copious drug dealers, Reedtown is the home of Marcus Anthony Hurley, a self-proclaimed member of the Reedtown Crip and Folk Nation and a convicted sex offender with a laundry list of other lesser convictions.

Known as Mark Anthony, the 6'1" bearded Hurley was convicted in 2002 of 1st degree sexual torture, his victim a 17 year-old girl. Sentenced to prison on April 5, 2002, he was a free man by July 16, 2003.

On September 18, 2003, Hurley visited the Hotskees Lounge in nearby Littleville. The small Colbert county town borders Franklin County on the north and is the closest community to Russellville that legally sells alcohol. There Hurley met an exotic dancer whom he repeatedly raped. This is the account of the ordeal as presented in case records:

The victim testified that in the early morning hours on September 18, 2003, she was working her second night as a dancer at Hotskee's Lounge in Littleville. As part of her job, she was required to dance in a bikini or bra and panties for tips and to persuade patrons to buy her at least six non-alcoholic drinks. She would also perform lap dances for customers, one-on-one personal dances performed in a back room. She testified that her shift had begun on the evening of September 17, 2003, and that it was not a busy night at the lounge. She testified that Hurley entered the club at approximately 10:00 p.m. Following her dance on the stage, Hurley tipped her, bought her some drinks, and they talked for about an hour and a half. She asked Hurley if she could perform a lap dance for him, and he agreed. She testified that she performed for him for one four-or-five minute song. During this time, she said, Hurley was respectful and did nothing inappropriate. That dance was the last one of the night for the victim. She testified that she went into the dressing room, changed clothes, and prepared to go home. As she was leaving through the front door, Hurley was waiting for her and asked her if he could walk her to her car. Because he had been a "perfect gentlemen" throughout the night, she agreed to let him walk her to her car. As they were walking to her car, she assumed Hurley had stopped under a breezeway, because he was no longer walking next to her. She testified that she got in her car, buckled her seatbelt, and began lighting a cigarette, when the passenger door opened. Hurley got into the car, and told the victim to "shut up." She testified that Hurley hit her twice in the head and told her to "shut up and drive." Hurley directed her to drive and pull into "what looked like it used to be a driveway" leading to an abandoned house.

Hurley instructed the victim to turn off the car's ignition and lights. He then placed her head in a "headlock," exposed his genitals, and forced her to perform oral sex on him. He then ordered her to remove her pants and underwear, pulled her on top of him while he was in the passenger seat, and forced her to have sexual intercourse with him. Although the victim continued to tell him "no," and that she needed to go home to her baby, he held onto her to prevent her from leaving the car. Following the rape, Hurley smoked a cigarette and allowed the victim to do so as well. Before she finished her cigarette, however, Hurley again forced her to perform oral sex and to have sexual intercourse with him a second time. She testified that they engaged in conversation and smoked another cigarette and that Hurley stepped out of the vehicle with his back to the victim to "use the restroom." The victim testified that she was too scared to start her vehicle. Hurley turned around and told the victim that she could leave, but that she better not tell anyone about the incident, because he would be back at Hotskee's. The victim testified that she pulled onto the main highway and was speeding toward the Littleville Police Department, when she was pulled over by an officer of the Russellville Police Department. After she explained that she had been raped, the officer escorted her to the nearest hospital.

The victim identified Hurley from a photographic line up, as the perpetrator of the crimes against her. Evidence was presented indicating that shortly after the incident occurred, police found Hurley sleeping on the porch of the abandoned home where the rape and sodomy had taken place. When he saw the police, Hurley immediately rolled over and put his hands behind his back to be handcuffed. He admitted that he had been at Hotskee's lounge that night. Evidence was also presented indicating that the DNA profile, taken from Hurley after his arrest, matched that taken from the vaginal swabs from the rape kit analysis performed on the victim on the night of the incident.

For his crimes, Franklin County Judge Sharon Hester sentenced habitual offender Hurley to life in prison. Two years later, he was free again.

Joseph S. Rushing prosecuted the Hotskees rape case against Mark Anthony Hurley, winning a conviction; however, Rushing used what the Alabama Appeals Court later termed inadmissible evidence of yet another previous rape. While not appearing on official Alabama sex offender records, Hurley had committed a very similar sexual assault for which he was convicted in 2000. From court records:

She testified that she first met Hurley on April 7, 2000, at a friend's house. She testified that a group of her friends was at the house when she arrived. Hurley was there, but she did not know him. Hurley took part in the group's conversations and mentioned several times going to the Waffle House breakfast restaurant. After he asked several times, she eventually agreed to go, observing that the appellant appeared to be a "nice guy." She testified that she went alone with him to the Waffle House "[j]ust to go eat." Instead of taking her to the restaurant, however, Hurley took her to his apartment, explaining that he needed to make a telephone call before they went to the restaurant. Hurley asked her to come into his apartment while he made the call. When they entered the apartment, Hurley lit a candle and pretended to make a telephone call before asking her if she wanted to go to the Waffle House. When she replied that she no longer wanted to go and asked that he take her back to her friend's house, he agreed and proceeded toward the front door. She testified that he then closed the door and pushed her toward the living room into a chair. As she begged him to take her home, Hurley began trying to take off her clothes. He proceeded to pull her pants down; he did not remove her underwear or remove the tampon she had inserted earlier before forcibly raping her. After he finished, she asked him to take her home. Although Hurley initially blocked her at the doorway, he finally agreed and drove her back to her friend's house. She testified that no words were spoken on the return drive.

During Hurley's second trial for the Hotskees rape, Joey Rushing, now Franklin County District Attorney, was forbidden to introduce the above facts and otherwise failed to prove force in the Littleville incident. To the delight of Hurley's Reedtown family and friends, the self-proclaimed gang banger was found not guilty.

Hurley returned to Reedtown, but moved often, and in March 2008 was indicted for failing to comply with the sexual predator registration act. Receiving only probation for that crime, Hurley once again remained free.

Soon the Reedtown Rapist was accused of a fourth illicit sex act, specifically the rape of a 17 year-old girl on June 7, 2009. His alleged victim stated she was beaten during the assault that took place at Hurley's Filmore Street residence. Hurley had disappeared by the time officers arrived at his home with the arrest warrant, and U.S. Marshals joined the Russellville Police force in a massive man hunt. Six days later, acting on a tip, authorities found Hurley at the residence of Desmond Hamilton.

Hurley posted a $75,000.00 property bond and returned to his home to await trial, but he was obviously not subdued by his plight. In February 2010, he was arrested again while out on bail--this time on drug charges. He was then indicted by a Franklin County Grand Jury on the charges of Possession of Marijuana and Drug Paraphernalia. What does it take to keep this man in prison?

Perhaps Rushing and Hurley's victims felt a plea was the only sure way to incarcerate Hurley. Now, he will serve at least three years and one day in jail for his latest rape. In March 2011, Franklin County District Attorney Joey Rushing deemed the split sentence the best way to ensure Hurley would do a substantial amount of time in prison and, considering previous jury verdicts, we agree.

After his release from prison, the 34 year-old Hurley will then face five years of probation. Any violation of the terms of his probation will send the Reedtown Rapist to prison to serve the remainder of his twenty year sentence. Mark Anthony Hurley's record goes back at least ten years; besides several rape/assault charges, Hurley has also previously been convicted of second degree escape.

Look for another chapter in the ongoing saga of the Reedtown Rapist after his release in two years...yes, two years. The year Hurley spent incarcerated after his bail revocation will count toward his time served. As VOCAL says, justice for all, even the victims.

The above account was taken from Shoalanda Speaks originally published June 17-18, 2009, April 14, 2010, and April 3, 2011.

Lloyd Hollis Hayes: From Fire Marshal to Purveyor of Porn

The following was taken from Shoalanda Speaks columns originally published November 6-8, 2010.

In May 1984, the Killen Fire Department of thirty plus volunteers announced that 28 year-old Capt. Lloyd Hollis Hayes was their new chief--for the second time since the previous December. A spokesman for the department would say only that the small group was a victim of internal problems. Now, Hayes was on his way to a successful career that lasted 18 years.

Married to the former Carol Lynn Mason Gresham, Hayes was the father of two young children and by 1989 had joined the Florence Fire Department where he served as captain. In 1994, Hayes ascended in rank to fire marshal, a position he held until he was terminated in 2002.

As part of his role with the Florence department, Hayes regularly participated in childrens' learning activities during National Fire Prevention Week each October. Hayes himself announced that the Florence program involved reaching young children not just in local public schools, but day care facilities as well. At the state level, Hayes helped establish youth groups connected to various fire organizations.

If Lloyd Hollis Hayes was unduly concerned with children, no one seemed to notice until January 2002. It was at that time the City of Florence conducted a routine audit of municipal computers. No one expected to find what appeared on Hayes' computer.

Possess computer images of adults in various states of sexual interaction and, while it may be sickening to some, it's not a crime. Possess photos of children in the same state, and you can go to prison for up to twenty years--in some states, the sentence is life.

For legal purposes, children are defined as being under 18 years of age, but most who are so horribly used, and even raped, for the gratification of those willing to pay for such images, are much younger. Florence Fire Marshal Lloyd Hayes agreed to plead to the charges on which he was indicted, so only those who were part of the legal investigation, prosecution, and defense know exactly what was on both Hayes' home computer and the computer provided him at work by the City of Florence.

From the July 17, 2007, New York Times:

Experts have often wondered what proportion of men who download explicit sexual images of children also molest them. A new government study of convicted Internet offenders suggests that the number may be startlingly high: 85 percent of the offenders said they had committed acts of sexual abuse against minors, from inappropriate touching to rape.

While Hayes may be part of the 15% (3 out of 20) who did not act on his fantasies, he was at least so addicted to child pornography that he risked his job, a very well-paying job, by keeping at least part of his pornographic collection stored on his computer at the Florence Fire Department. When a routine audit on January 11, 2002, discovered the illicit images, police also confiscated his home computer, finding more of the same.

The City of Florence placed the 45 year-old Hayes on paid administrative leave on Tuesday January 15th, a day after the fire marshal was arrested on three counts of possession of child pornography and seven counts of distribution of the same. His bail was 50K, not a difficult amount for someone in Hayes' income bracket to produce.

A short time later, Lloyd Hollis Hayes' status was changed to unpaid administrative leave; and his wife filed for divorce. If Hayes was to salvage anything from his downfall, he was going to need a lot of luck and a great legal defense.

As Lloyd Hollis Hayes sat in the Florence-Lauderdale Detention Center awaiting bond, he called Florence Fire Chief Charlie Cochran to express the love he had for his job, or more to the point, his former job. Employed under the Civil Service Act, Hayes was entitled to a due-process disciplinary hearing over which Cochran would preside. The fire chief stated at the time that friendship with Hayes would not influence him in his decision.

On January 25, 2002, Cochran heard three hours of testimony in Hayes' hearing, after which he recommended the former fire marshal be placed on leave without pay until the charges against him were adjudicated. Hayes was luckier during his hearing in District Court three months later.

District Judge Deborah Bell Paseur dropped the seven charges relating to distribution of child pornography since no money changed hands in the transfer of the images. Now, Hayes faced only three counts of possession of obscene material.

Hayes later agreed to a plea bargain in which two of the three remaining charges were dropped. Judge Mike Jones sentenced the former firefighter to a 30 month sentence. Under the agreement, Hayes wore an ankle monitor for nine months, while spending two years on probation. His defense attorney was quick to point out that the children pictured on Hayes' computers were not local. Well, thank goodness they were only children from third world countries.

Today Lloyd Hollis Hayes remains on the sex offender list, as he will for the remainder of his life unless current sex offender laws change drastically. It's a dismal ending for a once bright future; however, once he reaches the age of 60, Hayes will begin to draw his state retirement--our tax dollars at work.

The Tommy Morris Murder: 24 Years Later

The following account was taken from material originally published in Shoalanda Speaks on November 23, 2008.

Law enforcement officials in the tri-county area currently list a backlog of 15 unsolved homicides. The oldest of these is the murder of Tommy Morris, a 35 year-old special education instructor from Lauderdale County.

On the evening of October 17, 1986, Tommy Morris forwarded his phone to a sister's home and left his apartment in the University District of Florence; he was never again seen alive. By the next day, his two sisters became concerned enough to report him missing to the Florence Police, who initially dismissed the family's fears.

Deciding to take matters into their own hands, family members found Morris' car three days later near the intersection of Natchez Trace Parkway and Waterloo Road. The car had been torched, and authorities called to the scene found Morris' body locked in the trunk.

Tommy Morris had taught at Lauderdale County High School before transferring to Wilson a short time before his death. Morris, who was generally considered someone with designer tastes, also worked at Shankey's Men's Wear and Caster-Knott Department Store in Regency Square Mall. The school teacher, known for his elaborate wardrobe and expensive dental work, had friends in both high and low circles--a situation that made the investigation into his personal life that much more difficult. It was even rumored at the time that authorities videotaped Morris' funeral, but all inquiries led to dead ends.

Rich Thigpen, a former Rogersville resident who remembered Morris from Lauderdale County High School, speculated on the teacher's death. Writing in Prism Comics' online magazine, the openly gay Thigpen theorized that Morris' closeted lifestyle had contributed to his death. Whatever the motive, the murder was especially brutal and stood out to the detectives assigned to the case.

By December 1987, there had been little progress in the case when then-Lauderdale District Attorney Steve Graham announced the formation of a Special Investigations Unit consisting of the Lauderdale Sheriff's Department and the Alabama Bureau of Investigation. Graham emphasized the Morris death would be one of the unit's top priorities.

In January 1993, then-Sheriff Billy Townsend revealed that Morris' autopsy didn't confirm the teacher had been murdered; however, the department was still viewing the case as a homicide. Considering that the body was found locked in the trunk of his burned out car, it would seem less than logical to consider Tommy Morris' death anything less than murder. Many, especially Morris' family, were taken aback by Townsend's statement.

Charles Ford and Charles Perkins, Lauderdale County investigators, have since retired and handed the investigation over to Jr Witt. Since late 2005, Witt has received at least two new leads and still hopes to solve the mystery of Tommy Morris' death.

Next month will mark the 24th anniversary of Tommy Morris' death. Members of Morris' family still live in the area, as well as many of Tommy's former students; they deserve closure. Anyone with information concerning this crime should contact Witt at the Lauderdale County Sheriff's office.

Matthew Williams: No More Cruisin' on Woodward Avenue

The pony cars are cruisin' on Woodward Avenue.
Go and try to pass 'em, they'll smoke you if you do.

From The Horizontal Bop by Bob Segar

One doesn't have to be superstitious to realize that the Ides of March was unlucky for Matthew Daniel Williams. It was Saturday, March 15, 1997, when Williams died in a 10:20 p.m. drive-by shooting on Woodward Avenue. Reports indicated that Williams' red Mazda truck displayed symbols associated with the Crips; the other two occupants of his truck were Bradley Williams and his pregnant fiancee' Brandi Lee Campbell. Campbell was known to talk of gang related activities and flash gang signs at random--a strange affectation that may have directly led to Matthew Williams' death.

Matthew Williams, a graduate of Muscle Shoals High School, was attending Northwest-Shoals Community College at the time of his death. A member of the choral group "The Singers," he had a perfect 4.0 GPA. Muscle Shoals police were initially mystified as to how the conservative Williams had become involved in a gang related shooting. Their investigation later determined that Bradley Williams, no relation to the victim, had been in a verbal altercation with the shooter earlier in the evening. Was Bradley Williams the intended victim? Were gangs even involved? Had Brandi Campbell sacrificed Matthew Williams to save her fiance'? Did Matthew Daniel Williams take a bullet that was meant for someone else? It's hard to come to any other conclusion after reviewing the various statements concerning the drive-by shooting.

While driving north on Woodward Avenue, Matthew Williams was behind the wheel, while his friend Bradley Williams, an alleged member of the Crips, sat on the passenger side; between them sat Brandi Lee Campbell, often described as a gang-wannabe. Bradley Williams had been involved in a verbal altercation with 16 year-old Charles Eugene Black earlier in the evening. Now, Black was a passenger in a car driven by 18 year-old Jamie Allen Mackey. Three other youths rode in the back seat of Mackey's car, all either members of or closely associated with the Folk Nation.

As Mackey's car maneuvered alongside Matthew Williams' truck, Brandi Campbell saw the glint of a gun as it misfired. Telling her fiance' Bradley Williams to duck, Campbell followed suit, allowing the second shot to strike Matthew Williams in the head. According to Campbell's dramatic testimony, she knew he was dead as soon as she felt him slump against her.

A Colbert County jury took 45 minutes to convict Charles Black of capital murder. Black is serving a sentence of life without possibility of parole at the St. Clair Correctional Facility. Mackey was convicted of felony murder and is currently serving a life sentence at Limestone Correctional Facility; he is eligible for parole.

The third defendant in the case was Ben Edward Burt. A resident of Reedtown, the 37 year-old Burt was supposedly the Northwest Alabama leader of the Folk gang and a close associate of Mark Anthony Hurley, aka the Reedtown rapist. The Franklin County resident admitted to ordering a random hit on a member of the Crip gang and was given a plea deal for his testimony. Burt received a twenty year sentence and is currently incarcerated at Limestone.

According to Danny and Elaine Williams, Matthew's parents, while they accepted the plea deal, they expected Burt to receive much longer than his twenty year sentence. Now Burt's case is to be presented to the Alabama Board of Pardons & Parole on April 13. They are asking that all concerned citizens write the Board in protest of Ben Edward Burt's parole. N. Flippo and his wife Ruth were brutally murdered early that Saturday morning July 11, 1981? The blast that shook Red Bay, Alabama, at approximately 3:00 a.m changed the community forever. No one has ever been held responsible for the slayings, and after 28 years, no one may ever be.

When first awakened by the blast, neighbors assumed a natural gas line had exploded. Investigators who appeared within minutes of the blast quickly ruled out that possibility. Some were quick to mention plastic explosives since no fire was present--a ball of the highly combustible material could easily have been tossed through the picture window of the Flippo home. Others had a more practical idea.

Large amounts of explosives had been stolen from a Colbert County construction site the month before, never to be accounted for. A loose grate under the Flippos' bedroom and pieces of a shovel handle found nearby indicated to investigators that explosive material had been shoveled under the couple's bedroom and then ignited. Did the Flippos have enemies close enough to know in which bedroom they slept, or was it all a horrible coincidence? Redbay Police, Franklin County officials, and the ABI all chose to issue a gag order on any outgoing information, yet citizens of the small town were bound to talk among themselves.

Who or what had made the Flippo family the target of a lethal bombing? Whoever he was (and most bombers are male), he's never been caught.

J. N. Flippo Jr. was born in Hodges, Alabama, not far from the town in which he was murdered. He married his sweetheart Ruth and moved to Red Bay in the 1940s. The family raised three daughters who attended Red Bay Schools, while J. N. worked at a local bank, eventually becoming president.

Seeking to give back to his adopted hometown, J. N. ran for mayor and won the office easily, but decided to leave public service three years into his term. If anyone outside J. N.'s family knew why Flippo had become disenchanted with public office, they kept his secret as their own. Too young for retirement, J. N. opened an insurance office in the small town, and it prospered as had his other business endeavors. Except for the hour each morning J. N. visited with cronies at the local coffee shop, he was never far from the side of Ruth who helped with the insurance agency.

While all three of the Flippo's daughters had done well in school, those who knew the family called them shy. That combined with their relative affluence caused a few to term them snobbish, but those who knew them well said that was far from the truth. By 1981, the older two were married, and the youngest was away at college.

The weekend of Saturday July 11, 1981, one of the Flippos' cars was in the shop. Did someone think the couple was away for the night? A hidden grate behind the house appeared to be undisturbed, while someone had obviously loosened the more visible grate under the couple's bedroom, possibly indicating intimate knowledge of the home's floor plan.

A thundering blast rang through the town at 3:00 a.m. Responders were on the scene within minutes finding the 68 year-old J. N. Flippo, sleeping nearer the wall, already dead. Ruth, also 68, with splinters from the floorboard embedded in the calves of her legs was alive, but died twenty minutes later at Red Bay Hospital.

The entire town of Red Bay was in shock. As word spread that the blast was intentional, neighbors gathered to talk and grieve. Who would have killed the mayor and his family. Almost three decades later, the same town continues to ask the same question.

Four months after the explosion that both emotionally and literally rocked the small Franklin County town of Red Bay, three combined teams of investigators were no closer to finding their bomber than they had been on July 11, 1981. The three Flippo daughters had offered a ten thousand dollar reward for any information, with then-Alabama Gov. Fob James matching the amount. That amount of the reward in today's dollars would be roughly $45,000.00--yet, there were no takers.

After four years of no valid clues, then-Gov. George Wallace added still another ten thousand dollars to the available rewards. Investigators decided to release small amounts of information. An ex-boyfriend of the youngest daughter had been cleared, as had a band of Marion County bootleggers who lived near the home of one of the Flippos' older daughters. While never completely authenticated, investigators by now believed that Flippo, the former president of Red Bay National Bank, left the mayor's office in 1975 because of a temporary health problem. They also believe that Ruth, a retired school teacher, heard the bomber as he placed the explosive under the bedroom, causing her to attempt to stand and resulting in her unusual injuries. Those at the scene said her last words were, "Oh, somebody please help me."

By January 1993, Franklin County Sheriff Larry Plott declared the case at a dead end. Without new information, there was nothing left to investigate. The TimesDaily lists the 1985 murder of Florence teacher Tommy Morris as one of the area's oldest unsolved cases. Perhaps Red Bay sits too closely to Mississippi for many in the Shoals to remember the tragic deaths of J. N. and Ruth Flippo.

Their daughters and friends still remember. There's still a $30.000.00 reward offered for any information leading to the murderer(s). Surely someone knows something...

More Crime Blogs !!!

For those who just can't get enough crime, we offer...

Crime

We haven't had a chance to visit all of the blogs listed, but it certainly looks like there's something for everyone.

Delmer & Amanda Duboise Do...Their Students

This account of father/daughter sexual predators originally appeared in Shoalanda Speaks on December 26, 2009, and February 12-13, 2010.

Amanda Duboise Watkins' Facebook address is girlinterrupted1. The 38 year-old Watkins was certainly interrupted when she was found having sex with a 15 year-old male in late December 2009. Watkins is, or perhaps more correctly was, a teacher at Sheffield Junior High School; her male companion had been her student the previous year. What would possess an attractive married woman with multiple degrees, not to mention a young daughter, to risk everything for a few moments of sexual passion with someone who's hardly more than a child? While many apparently see humor in this, it is no different than an older man taking advantage of a younger female student. These relationships are taboo for a reason, but are seemingly becoming more and more commonplace. Could anyone have foreseen this kind of deviant behavior from Watkins? Perhaps one needs to look no further than her father, a former educator convicted of solicitation of a student.

Amanda Duboise is a native of Phil Campbell in Franklin County. After graduation from high school, she attended Northwest Shoals Community College before advancing to the University of North Alabama where she met her husband Carter Watkins, a Florence native who graduated from Hibbett Middle and Coffee High Schools. Carter Watkins also majored in journalism and is currently employed as WHNT's Chief Photographer for the Shoals Bureau. Together, Carter and Amanda resided in Forest Hills with their daughter Grace Anne and dog Toto.

Perhaps their marriage looked idyllic only from the outside. Sheffield Superintendent Richard Gardner reported that he had spoken with Watkins over another incident two years ago. Gardner did not specify the exact nature of the problem, but did state that it was not sexual in nature. Now Amanda Duboise Watkins has been released from the Muscle Shoals Jail on $15,000.00 bond, while also having been placed on paid administrative leave at Sheffield Junior High.

Social networking site photos of Watkins show her wearing a cross; she lists her favorite Bible verse as "I can do all things through Christ who gives me strength;" two of her Facebook organizations are I Love Jesus and I'm Proud to be a Christian. Here, in her own words, is the vision Amanda Duboise Watkins had of herself:

Before entering the world of education, I worked as a reporter and freelance writer. My original degree from the University of North Alabama was in journalism. I have always loved reading and writing. I worked as a freelance reporter for the Times Daily, a staff writer for the Franklin County Times and wrote various freelance articles for a few magazines. I even worked at WVNA Radio in Tuscumbia. I decided to go back to obtain my masters after the birth of my daughter. It is a decision that changed my life. I absolutely love what I do. Today's young people are our future. We need to do all we can to make a positive impact on their lives and their educational experience. Every student has his/her own unique talents and abilities. Teaching allows me to help students make those discoveries or further develop ones they have already uncovered for themselves. Helen Keller once said, "Its a terrible thing to see and have no vision."

Now, unless offered a plea, Watkins will be branded a sex offender and never teach school again. She also may be required to serve time in prison. Her family deserved more, and certainly the young man she seduced deserved and expected more, as did his family. Teacher sex is a crime--a crime no less serious because the offender may manage to plead to a lesser offense. If our children aren't safe at school, how can we expect them to be safe anywhere?

Yes, Amanda Watkins has been accused of having sex with a 15 year-old former student. Actually, from early accounts of the arrest, the 38 year-old Mrs. Watkins was literally caught with her knickers down. Now the Sheffield Board of Education is refusing to name the infamous teacher in public reports, and a reporter with the Associated Press in Montgomery is asking why.

Mrs. Watkins' father has been active in North Alabama and State politics since his daughter's birth. In 1972, Delmer Duboise, then a resident of Phil Campbell, ran for delegate to the Democratic National Convention. By 1975, Duboise had been elected to the Franklin County Board of Education. As a member of the Board, Duboise prided himself on his attempts to halt the cash-strapped Board from excess spending. In fact, Duboise was so vocal in his criticism of the Superintendent, few doubted his next move would be an attempt to unseat then Superintendent Jimmy Clements.

By 1977, Duboise had been appointed Franklin County Uni-Serv Director of the Alabama Education Association , becoming friends with Paul Hubbert. In September 1978, Duboise abruptly resigned as Chairman of the Franklin County Democratic Party; the next month saw him ensconced as the administrative assistant to Jim Folsom Jr., then head of the Public Service Commission.

In 1980, Delmer Duboise saw his first political setback when opponents of Folsom presented evidence that the administrative assistant was using a PSC vehicle to travel from Montgomery to his home in Russellville. Duboise's political aspirations hit an even greater snag in 1982 when six black staff members of the PSC accused him of "racially discriminatory action."

By 1984, Duboise was back home in Russellville and seeking to become the first director of the Russellville Industrial Development Board. After not making the final cut, Duboise decided to return to the realm of education. At that time, Northwest Community College, then a separate entity from its sister school in the Shoals, was in need of a Public Relations Director. Sources say Duboise used his influence with Paul Hubbert to secure the position. For the next few years, Delmer Duboise's star was again on the rise.

Delmer's daughter Amanda Ladel Duboise Watkins is no longer an employee of the Sheffield School System if we are to believe local news reports. Yet, the Sheffield Board of Education refuses to verify that fact, referring all inquiries to their attorney. What does their legal representative say? He has yet to return calls to the Associated Press in Montgomery.

Rest assured that Mrs. Watkins is still a member of the Alabama Education Association, a teachers' union headed by Paul Hubbert, a one-time friend and associate of Watkins' father Delmer Duboise. The elder Duboise served as both instructor and Public Relations Director for Northwest Community College for approximately ten years, leaving the small two-year institution in 1996.

According to newspaper accounts from that era, Duboise, then 47, was arrested on May 27, 1995, for criminal solicitation. According to Franklin County authorities, Duboise offered a 20 year-old male student the munificent sum of $25.00 to engage in a sex act. (Feel free to inject any jokes about the Bill and Chelsea Clinton of Northwest Alabama.) In case you think the amount $25.00 was a typo, rest assured it is not. That amount would equal approximately $34.31 in 2010.

Duboise, dubbed by wags as "Delmer Dubious," announced that he had been set up by his political enemies and demanded a trial sans jury. Franklin County was adamant that Duboise should be judged by a jury of his peers--thus producing an extended legal battle in which the AEA provided Duboise assistance. While awaiting trial, Delmer Duboise was assigned to the Institutional Research Department at Northwest Community College.

After a legal battle that finally terminated in the Alabama Supreme Court the next March, Duboise was allowed to be tried without a jury. The Franklin county educator was eventually offered probation for the misdemeanor offense and quietly left academic life. For the past several years, Duboise has been mentioned in various news outlets as a "minister."

Have Delmer Duboise's connections to Paul Hubbert and Jim Folsom Jr. influenced the stance of the Sheffield Board of Education? Their refusal to discuss the incident with the press has not made the sex charges against Amanda Duboise Watkins go away; their refusal has made the Montgomery AP journalist just that more determined to report on the situation.

Amanda Duboise Watkins' first appearance in Colbert County District Court is scheduled for May 2010.

Who Murdered Little Miss Sunbeam's Killer?

The following account is taken from columns that originally appeared in Shoalanda Speaks December 19-24, 2009.

It was 1942 when Quality Bakers of America, located in Philadelphia, Pennsylvania, introduced a brand of white bread that it dubbed Sunbeam. In an era before rapid transit, an era that was also shrouded in war time restrictions, Quality Bakers decided to franchise its product. In Alabama, the Flowers Bakery Company produced Sunbeam Bread, a product whose recipe quickly made it a favorite of the American consumer.

Just as in today's tight economy, marketing could make or break a product in the 1940s, and Quality Bakers hired illustrator Ellen Segner to create a brand icon that would distinguish it from other products, most importantly Sunbeam Appliances. Segner, who died in 2001, was noted at the time for her semi-erotic pin ups, but is remembered today for her creations of Dick and Jane, as well as Little Miss Sunbeam.

While sitting in a New York park, Segner saw a young blond girl playing. She immediately took out her sketch pad and created what was to become one of the most recognizable faces of the late 20th century; however, before Segner could approach the child to offer her a formal sitting, the little girl had disappeared. Segner then used other models to finish various portraits that came to represent Sunbeam Bread in advertising across most of the United States.

After the war, Sunbeam Bread continued to grow in popularity, and one franchiser hit upon the idea of selecting a real-life Little Miss Sunbeam to represent their area. The first Miss Sunbeam, Patty Michaels, was chosen in the New York area in 1955, but finding public appearances too tiring, left the Sunbeam company after only two years. Michaels went on to appear in The Sound of Music and enjoy a moderately successful recording career.

With the success of this live mascot in one geographic area, other franchisers followed suit. Flowers Bakery held its contest for a Miss Sunbeam in the late 1950s, and thus Marie Burns of the Central community in western Lauderdale County became the Southeast's Little Miss Sunbeam, enjoying the title's fame well into her adulthood when, in the mid-1980s, she was killed by impaired driver Wilburn May Jr.

Those who knew Wilburn May Jr. universally called him "Junior." They also called him other names that colorfully described his usual state of inebriation. It wasn't unusual to hear customers of the Central Heights Pharmacy tell each other to watch out on the way home--Junior May was on the road.

In the early 1980s, May was involved in a drunken crash that left him paralyzed from the waist down. Apparently no charges were filed in that crash, and Junior May continued to drive a modified vehicle--still drinking and now under the influence of narcotic pain killers.

It came as no surprise when a a few years later a drunken May hit another car head on; it was a shock to the community that the dead passenger in the car was Marie Burns, a former Little Miss Sunbeam and the mother of four children. It was also a shock when May was again allowed to plead to a lesser charge than manslaughter and was given only a slap on the wrist in Marie Burns' death.

Divorced, May still had family who attempted to help him recover from his addictions, but to no avail. Now, May was not only an addict himself, but had also taken on the mantle of local drug dealer. In 1998, his drug dealings caught up with him when a family member of one of his customers reported him. Junior May yet again cheated justice--this time due to his condition. Apparently the state had no wish to house a paraplegic whose body was ravaged by a lifetime of alcohol and other drug abuse. Wilburn May Jr. was given probation and allowed to return to the Central community where he again set up shop selling drugs and some said fencing stolen merchandise.

For the next three years, May operated out of a hospital bed set up in the living room of his small house on County Road 15. This is where family members found the body of Wilburn May Jr. lying in his hospital bed on the morning of February 26, 2001; a single gunshot wound to the chest was circled in dried blood. May, 45 years old and a known drug dealer, had many enemies--some of them due to his role in the death of the former Little Miss Sunbeam Marie Burns, but after a four month investigation, the Lauderdale County Sheriff's Department had found every lead to be a dead end. By the end of June 2001, the reward in the case totalled $16,000.00; but the first real break came from a Madison County law enforcement officer.

Donald Wayne Darling II was seventeen years old and lived less than a mile from Wilburn May Jr. on County Road 15 in the Central community. Now Darling was an inmate at Three Springs School, a Madison alternative correctional facility for juveniles where he had been held since May 1. According to authorities, Darling told a roommate he had killed May. When Lauderdale Investigator Jr. Witt visited with Darling at the school in mid-July, the teenager denied the charges, but admitted he had bought drugs from May twice in the past. Witt was convinced that Donald Wayne Darling had killed Junior May and secured a search warrant for his Central Heights home. Investigators were secretive concerning their finds, but immediately requested a warrant for Darling's arrest.

Taking Darling into custody the next day, Lauderdale County assigned Doug Evans to prosecute the teenager. The Assistant District Attorney immediately requested an upgrade in Darling's charges--now Donald Wayne Darling was accused of capital murder in the killing of Wilburn May Jr. Evans based the new charges on accusations that Darling had also stolen drugs at the time of the killing, a killing the prosecution believed to be the result of a gang initiation. Darling defense attorneys offered a different scenario, but District Judge Deborah Bell Paseur now ordered Donald Wayne Darling held without bail.

Darling spent almost two years in the Lauderdale County Detention Center awaiting trial, while defense attorneys Jenny Behel and Chris Connolly filed various motions and maintained that Jr. Witt had illegally questioned Darling, setting the stage for what was to become a lengthy battle of words--not the least of which were prosecutorial misconduct. In the mean time, was the real killer still out there?

The State's case against Donald Wayne Darling II hit roadblocks from the beginning. Darling himself claimed he had bragged of murdering Wilburn May Jr. in order to impress gang members with whom he was incarcerated in Madison. The day before Jr Witt had traveled to Madison to interview Darling, the teenager had attempted to hang himself and was under the influence of powerful anti psychotic drugs during questioning. Of the items taken from Darling's home by Witt, some proved to belong to Darling's father. Prosecutors in the case failed to allow the Darling defense to inspect the items, a fact that drew the ire of Judge Mike Suttle who had been assigned to hear the capital murder case.

As the trial began, the case against Darling began to unravel even further. The defense proved May's front door was kicked down by an individual with a larger foot than the teenager's and none of the defendant's shoes matched the sole pattern as the prosecution initially claimed. The defense also produced witnesses that several individuals, including May's ex-wife, had recently threatened the murdered drug dealer.

As the trial progressed, Chris Connolly asked for a mistrial based on the possibility of prosecution witness Torry Harrison being released early for his testimony. The witness had testified previously in several other trials in return for special considerations. Also, a main point of contention in the Darling trial was the witness being allowed to wear street clothes to the proceedings (We will inject here that even those who are incarcerated should be allowed some dignity--as long as the jury was advised that the witness was currently serving time in the Colbert County Jail, his clothing should have made little difference). Further, Junior May's heavily peroxided blond daughter Nancy Stevenson testified that she believed her father had also been beaten and that his axe had been turned over to Lauderdale deputies, but was not introduced into evidence. If May had been beaten, as his daughter claimed, this was another element that clashed with Darling's initial and supposedly drug-induced confession.

After two days of deliberation, the jury announced it was deadlocked, and Judge Mike Suttle declared a mistrial. Darling was returned to the Detention Center to await a second trial, but his defense attorneys had other plans--they immediately filed charges of prosecutorial misconduct by the Lauderdale County District Attorney's office.

Judge Mike Suttle took the charges of prosecutorial misconduct in the Donald Darling murder trial so seriously that he ordered a jury trial in the matter; however, the Lauderdale District Attorney's office appealed the ruling and won. Now, Darling was to face a second trial for the murder of Wilburn May Jr.

By May 2004, Darling had been released on bond, and Lauderdale District Attorney Steve Graham had resigned. Graham's successor, then Republican Billy Jackson, knew the Darling family socially and recused his office from the second trial. Even Judge Suttle's role was questioned due to his announced support of Darling's defense attorney Chris Connolly, Jackson's Democratic opponent in the upcoming election. Suttle refused to step down and presided over Darling's second trial, now moved to Decatur.

During the trial, the defense team introduced evidence that included an alibi for Darling and accusations against one of May's ex-wives as well as a known drug associate who had not been seen since May's murder. On July 23, 2004, a Morgan County jury found Donald Wayne Darling II not guilty of the murder of Junior May. Suttle then authorized protection for the Darling family as they left the courthouse due to alleged threats from the May family. Darling himself spoke of his relief to have an unencumbered future.

What did Donald Darling do with his freedom? Less than four months later, the now 20 year-old Darling was accused of attempting to break into a condom vending machine at a Central Heights mini-mart. He pleaded innocent to the misdemeanor charge. Two years later, Darling was arrested for breaking into a convenience store to steal cigarettes; a short time later an intoxicated Darling was arrested by an observant off-duty deputy immediately after breaking into a truck in the Central community.

Do Darling's post acquittal criminal actions indicate he was in reality guilty of killing Junior May? They certainly indicate Donald Wayne Darling II placed little value on his freedom. As for who did murder Little Miss Sunbeam's killer, one of the strangest cases in Shoals crime history is still officially open.

The Strange Tale of Brandi Lee Campbell

My brother passed away on 6/18/2008. He is missed very deeply by all of us! God rest his soul and I know I will see him again one day. - Brandi Lee Campbell

Brandi Lee Campbell entered the above quote on her MySpace page, the social networking site she opened on June 25, 2008. In reality, Brandi's brother, Bryan Ray Campbell, died around one o'clock in the morning on June 19. Brandi Lee Campbell shot her brother with a .410 calibre pump shotgun, and he was pronounced dead at Helen Keller Hospital later that morning.

Some friends and relatives of Brandi claim she had previously threatened the life of her 32 year-old brother, the single parent of a young daughter fighting acute myelogenous leukemia. Brandi, Brian, and Brandi's new husband, Charles Johnson, were all drinking the night of the shooting, so the truth may never be known, but Brandi claims she killed her beloved brother in self-defense and to protect her ten year-old son Brandon Williams, a witness to the killing.

Sheffield detectives who investigated the shooting were familiar with Campbell-Johnson, who had been involved in three previous death investigations and countless domestic disputes. They wanted her charged with murder, but the only witnesses were her husband and son. Despite her family's sworn statements, Sheffield police initially arrested Brandi Lee Campbell for felony murder, but they weren't prepared for what happened next.

Brandi Lee Campbell and her brother Brian Ray were the product of Terry Kiker's marriage to Ray Campbell. After her divorce, Terry Kiker Campbell became the breadwinner for her family, attempting to make the best life she could for her family.

Friends remember both Brian and Brandi as outgoing children, always seeking to be the center of attention. As Brian matured, he began to call himself "Big Daddy" and nicknamed both friends and family, usually including the word "Lil" in the appellation.

Brandi was "Lil Sis" to Brian, but she had big ideas. Pregnant at 17, she claimed to have graduated from Muscle Shoals High School in 1997, while according to her family, Brandi was a dropout who earned a GED. She enrolled at Shoals Community College the next year. Brandi Lee lists her major as "Paralegal" and her minor as cosmetology. Networking sites also list her occupation as paralegal, but her only job since graduation was at B & B Hair Salon in Muscle Shoals.

Brian had similar problems in settling on a career, but at the time of his death had become a truck driver, an occupation his friends thought suited his wanderlust. Both married, with Brandi Lee quickly divorcing, and Bryan finding temporary happiness. After the birth of their daughter, Madison, Brian and his wife Angela separated, but remained friends until her death from a drug overdose--a situation that enraged Brandi Lee, the last person to see her sister-in-law alive.

Single again, Brandi Lee began to live her life closer to the edge, often referring to her relationships with gang members. Sources say her penchant for flashing gang hand signals at random ultimately led to the death of a companion who took a bullet meant for her boyfriend. Another boyfriend died minutes after leaving Brandi, a veritable pharmacy in his system. By now, Brandi Lee Campbell was definitely on the local police's radar.

The year 2008 initially brought happiness to the Campbell siblings. Bryan Ray had started his new job as a truck driver, and his daughter Madison's leukemia was in remission. Brandi Lee met a new man and promptly fell in love. The fact that he was engaged to another woman didn't deter Brandi in her pursuit of her "soul mate" and she married Charles Thompson in June.

The night of June 18th, 2008, Bryan visited his sister and her new husband at their small house on Annapolis Avenue in Sheffield. Leaving Brandi's son Brandon Lee at home, the three adults decided to celebrate. After a night of heavy drinking, the three returned to Brandi Lee's home a short time after midnight. Realizing he was in no condition to drive, Bryan stated that he wanted to ride Brandon's bike the few short blocks to his mother's.

Bryan had given the bicycle to his nephew, but Brandi refused to let her brother take it. According to all present, the mood soon turned ugly, and Brandi and her husband began to beat Bryan with pool cues. From this point, the stories of the three survivors vary, but they all end the same way: Bryan Ray Campbell lay dead in the dining room of his sister's home.

Brandi stated she shot her brother as he attempted to force his way back into the house after being ejected by her new husband; however, only two empty shotgun shells were found--one on the front lawn and one in the middle of the street sixty-five feet from the front door. A trail of blood stretched across the porch into the house. After examining the scene, police took Brandi Lee in for questioning and formally charged her with murder the next day. Taking her past brushes with the law into account, the arresting officers felt the charge would be easy to prove. Even Brandi's mother announced she wanted justice for her son.

However, after reviewing the forensic evidence and reading the conflicting accounts of Bryan's death, the Colbert County District Attorney chose to charge Brandi with manslaughter, a crime that could bring up to twenty years in prison. Judge Hal Hughston set Brandi's bond at $10,000.00, an amount that would ordinarily be difficult to obtain for a hairdresser with no property. The next morning, Brandi Lee's stepfather, Curtis Johnson, arrived at the jail to post bond.

Family members were shocked by Johnson's actions, as were the arresting officers, but nothing prepared them for the grand jury's ruling. Despite the discrepancies between Brandi's statement to the police and the actual evidence, a Colbert County grand jury refused to indict her in her brother's death. Brandi Lee Campbell had once again escaped her actions unscathed.

With the threat of prosecution behind her, Brandi Lee Campbell was now free to put her life back together. A second chance is rare for many, but Brandi now had a third, or even fourth chance to become a productive citizen, a caring mother, a loving daughter.

What Brandi didn't have was a second chance to become a good wife; Charles Johnson immediately left Brandi and requested the dissolution of their marriage. According to Brandi's MySpace page, she's still looking for that perfect soul mate. Unfortunately, Campbell seems to be looking in all the wrong places.

Arrested twice in Colbert County in September for Public Intoxication, Brandi was also arrested early in October for DUI. Later that month, Sheffield police arrested Brandi on a domestic violence charge, an arrest that sources say stemmed from an attack on a new boyfriend. After her move to the Holiday Trailer Park in Muscle Shoals, the Department of Human Resources reopened its file on Campbell who faces the permanent loss of custody of her son who is now living with his paternal grandparents.

Still, Brandi told both friends and family that she was getting her life back together. On December 23, 2008, Brandi Lee Campbell drove her mother's automobile into the front of Lewis Electric on Second Street in Muscle Shoals. When the investigating officer attempted to take Campbell into custody, she resisted and was forcibly taken away.

We've heard that Christmas in jail isn't pleasant. Besides several bad check charges, Campbell had three outstanding warrants for possession of a controlled substance. After being apprehended and serving a short sentence in the Muscle Shoals City Jail, Campbell entered a rehab facility.

Taken from columns originally published in Shoalanda Speaks on December 26-29, 2008, and November 9, 2009.

Jennifer Hampton: Murdered by Illegal Immigrant

The following account is taken from columns that appeared in Shoalanda Speaks November 20-25, 2009.

The young Guatemalan had walked for miles. He was determined to make it to the United States for a better life. As he walked, he thought of all he would need when he arrived in his new home--a companion came to mind, one who spoke Spanish. By now he was in Mexico, having hitched enough rides to make good time in his trek. He stopped in a village filled with the poorest of the poor, a village where some families lived in cardboard shacks.

When the young man left the village, he resumed his trip north with a 14 year-old girl for whom he had paid the equivalent of $20.00. This terrified child was to be his companion for the next five years as he made his way to Athens, Alabama, and began work in the Sweet Sue plant.

His "bride" was not allowed out of the house or allowed to learn any English with the exception of what she gleaned from television. She attempted to escape, but the birth of her first child chained her to her captor. It was during her second pregnancy that the neighbors on the quiet Athens street heard her screams from the latest beating and called the police. The Guatemalan quickly headed south, ostensibly returning to his homeland. The girl was now 19, heavily pregnant, and forced to live off the charity of a Hispanic family in Decatur.

When she delivered her second child, she arrived at the hospital in so late a stage of labor that the physician would not give her any pain medication. Holding the hand of a student nurse who stood next to her while communicating in Latin and praying for the young woman and her child, the girl gave birth to a second son. Now she had two anchor children, no education, and no money. What became of this young woman and her children? We don't know...

The above story is true and is related here to present two very different sides of immigration. Are we against all Hispanic Indian immigration? No. Do we see the problems illegal immigration brings? Yes.

Valentino Miranda is a man very much like the one in this story. Last year he killed a young Florence woman who was visiting Knoxville, Tennessee, on business. Now his attorney says he didn't understand his aptly named Miranda rights when he was questioned in the death of Jennifer Hampton. Will this stop his trial? No. It probably won't even slow down the judicial process that will bring a sure punishment to this brutal rapist and murderer. What punishment does Valentino Miranda deserve? Our individual answers to that question say a great deal about us.

Jennifer Lee Hampton was 21 years old when she died, scores of miles from her high school friends in Waterloo and the various homes in which she had lived during her short life. According to officials at Waterloo High School, Jennifer lived with a sister while attending school. Her mother was barely in the picture, and no one knew if a father even existed.

If these things discouraged Jennifer, she tried not to show it. While at Waterloo High she was voted Homecoming Queen her senior year and acclaimed the most dependable. If one looks at photographs of Jennifer, one may not see the type of girl that is normally elected homecoming queen. She wore no fancy frock or lashings of make-up. Jennifer won the title because of what she was on the inside.

Neither was Jennifer rich; she had little or no money for college and was unsure of what she wanted to do with her life. After working in restaurants for a little over a year, Jennifer announced she wanted to be a nurse. Accepted at a local nursing school, Jennifer continued to work for what she wanted. Living in an apartment in Muscle Shoals, she worked as a server at Mama Blues Restaurant in Florence. Jennifer was so proficient in her job that owner Steve Barnhill chose her to be on the team that trained new employees in other towns.

Friends say Jennifer loved the opportunity to travel and was eager to train workers at a new Mama Blues in Knoxville. It was in Knoxville that she encountered illegal immigrant Valentino Miranda, the man who brutally raped and murdered her.

Valentino Vasquez Miranda had migrated to the United States illegally and, like the Guatemalan immigrant in the above tale, was living with a common-law wife over whom he exerted total control. Miranda and Rosa Rodriguez Hernandez shared a room at the Days Inn on South Lovell Road in Knoxville, the motel at which the Florence Mama Blues' employees were housed during their stay. When Jennifer Lee Hampton entered Room 148 on the night of September 19, 2008, she had no idea it was to become her death chamber.

Nick Patel, manager of the Days Inn, had hired the 19 year-old Miranda and 38 year-old Rogelio Dominguez Melchor to do maintenance work at the motel. Both immigrants presented illegal social security cards--a fact that Patel vehemently hangs on to in his assertion of total lack of responsibility in the crime. Both Miranda and Melchor possessed key cards allowing them entrance into the guests' rooms. As recently as the week before, a female patron had complained of Valentino Miranda entering her room in the middle of the night, but management refused to respond to her charges.

Sometime after 3:00 a.m. on the morning of September 20th, Miranda entered Jennifer's room with the intention of raping her. Miranda is the only living person who knows what happened next, but forensic pathologists have stated that the former Waterloo homecoming queen put up a prolonged fight. When a shaken fisherman found her nude body seven days later in Melton Hill Lake, Jennifer was missing a tooth, showed marked defensive wounds, and signs of sexual attack and strangulation.

Now, with a body in their possession, the Knoxville authorities arrested Miranda, charging him with First Degree Murder. Hernandez had willingly handed over the bloody clothes Valentino Miranda had worn that night, and semen from the sexual assault kit matched Miranda. The Knox County District Attorney announced that it would, in effect, be a slam dunk case.

After medical examiners identified the body found in the lake as that of Jennifer Lee Hampton, her family in Lauderdale County began to make funeral arrangements. At first, family members were concerned over a lack of funds, but individuals who had never met Jennifer stepped in and took over.

Police departments between Knox County, Tennessee, and Lauderdale County, Alabama, escorted the former homecoming queen's body to the Morrison Funeral Home in the Central Community. KK Edgil-Hargett who works with rape victims and their families assisted the Hampton family in getting a reduced rate from the funeral home. Even as Shoals residents came forward to aid the family locally, stunned residents of Knoxville had begun their own efforts to collect funds for Jennifer's family.

After Jennifer was laid to rest in a private ceremony on October 2, 2008, it had become clear that the initial expenses had been more than taken care of by the generous outpourings of those who had never met Jennifer during her short life; but others, still in shock at the brutal murder, wanted to contribute.

Two female Lauderdale deputies initiated a nursing scholarship at Northwest Shoals Community College in Jennifer's honor. Bette Terry, a Registered Nurse who also works with rape victims, had already begun a fund in Jennifer's memory. Tina Parker, current candidate for Colbert County District Judge, assisted with the collection of funds and suggested memorializing Jennifer in the next Safeplace fundraiser. When it became apparent that the minimum funding to enter the Safeplace walk would fall short, an anonymous Florence businessman contributed the difference. Jeff Miller designed the tee-shirts, and on April 4, 2009, a team honoring Jennifer Hampton participated in the annual Safeplace Walk-a-Mile-for-a-Child.

Jennifer Lee Hampton now lives on in the memories of those who knew and loved her. We hope those who have contributed in her memory to scholarships and the eradication of violence toward women know that they also have ensured Jennifer's memory will influence future generations of young women. Yet, Jennifer's story is not finished.

Yes, Valentino Vasquez Miranda brutally beat, raped, and murdered Jennifer Lee Hampton. He then disposed of her body in a nearby lake where it remained for seven days. His skin and semen were found on Jennifer's body, and his victim's blood was found on the clothes Miranda wore the night of her murder. Rosa Hernandez, Miranda's common-law wife, saved the clothes her husband wore that night, clothes with Jennifer's blood on them. Now Miranda's defense attorney says his client has been illegally detained for the past 14 months. Why? Valentino Miranda did not understand his Miranda rights when they were read to him.

Joe Fanduzz, Miranda's court appointed attorney states that his client understands little or no English and may not have comprehended the fact that he did not have to answer the questions posed him by Knoxville, Tennessee, detectives. Did the Knoxville police not provide an interpreter for the suspect?

It seems the Knoxville Police Department did indeed provide Miranda with an interpreter, but the individual used was not certified by the correct authorities, whoever they may be. Does that mean the interpreter did not adequately inform Miranda of his rights--rights guaranteed by the United State Constitution? No, it seems that point is not really in question. While Miranda did not sign a release (apparently he cannot write his name), he did nod in agreement and acceptance. Fanduzz's argument is simply the lack of official status of the interpreter. A Knox County judge is set to rule on the defense motion on December 15th. Miranda's trial is still scheduled to begin January 11, 2010, at which time Fanduzz and his step-father John Eldridge will attempt to defend Miranda.

We say attempt to defend, because there can be no defense for what Miranda did. Does he deserve the death penalty? In most cases, we oppose the death penalty for a variety of reasons. In this case, we have no doubt of Miranda's guilt and feel that he, unlike most of us, would actually enjoy a better life in prison than he would in the free world. Pray for justice for Jennifer Lee Hampton.

Greg Wright - Murdered for Seventy Dollars

The following was taken from columns originally published in Shoalanda Speaks September 22-25, 2009.

How do you measure success? Obviously, we each have different bench marks in our appraisals of others, as well as ourselves. If we count success in friendship, then James Gregory Wright was a successful man. If we count success in dollars and cents, Greg Wright was lacking, and this lack led to his murder.

Wright was a 42 year-old roofer who lived by himself in the Greenhill community of Lauderdale County, just a mile south of the Tennessee State line. Due to the economy, Wright had been out of work for some time, forcing him to live frugally in his manufactured home. At some point in 2006, Wright purchased a set of used tires from Greg Leon Nard for $70.00. Those who knew Wright say that he would have paid Nard when he went back to work, but Nard became upset over the debt.

On the night of January 27, 2007, Greg Nard, 25, his father William David Nard, 47, and an acquaintance, Norman Ernest Widdowson, 42, were out joyriding. All three were residents of Iron City, Tennessee, but Widdownson had moved from Maryland only three months before. After a night of shooting pool and drinking at the Nard residence, the father and son suggested to Widdownson that he accompany them on a drive; they wound up at Greg Wright's residence on Lauderdale County Road 130. The three men were the last to see James Gregory Wright alive.

No one had seen Greg Wright since the previous Saturday; nor had anyone seen his vehicle moved from the driveway of his manufactured home in the Greenhill community. It was 7:30 the next Wednesday when a neighbor decided to check on the unemployed roofer. Reaching the steps to the wooden deck, the neighbor discovered a dried brown substance on the planks. The same substance dotted the flooring of the deck, and upon reaching the storm door in the mid-winter darkness, the neighbor's fears were confirmed as he once more saw the substance, now dark red against the glass and streaked across the storm door.

Inside, the body of James Gregory Wright lay on the living room floor, face down, rivulets of dried blood surrounding it. Lauderdale deputies arrived minutes after receiving the call, initially determining that Wright had died from blunt force trauma to the head. Friends and family who arrived at the scene could offer no insight into Wright's death; his mother and stepfather terming him universally liked.

Fortuitously, investigators didn't have to wait for blood and other trace evidence to be evaluated; Greg Leon Nard had dropped his cell phone during the struggle. When questioned by investigators in Iron City, Nard quickly offered his father William and companion Ernest Widdowson as alibis. Upon further questioning, Widdowson confessed to accompanying the father and son to Wright's Alabama home to collect the $70.00 debt, but stated he remained in the vehicle during the crime and couldn't be sure which Nard had inflicted the wounds that claimed Wright's life.

Now, sure of their case, but unsure of just who did kill Greg Wright, deputies then questioned the Nards separately. Each accused the other.

Lauderdale County investigators were faced with three conflicting statements in the murder of Greg Wright. Father William Nard accused his son Greg of the crime, while the son accused his father. Accomplice Ernest Widdowson maintained total innocence in the act itself, while both men averred their friend assisted in the murder and robbery. Lauderdale County prosecutors prepared their cases against the men, initially considering charging all three with capital murder. Denying bail to the trio, the county housed Widdowson in the Lauderdale County Detention Center, while placing William Nard in the Franklin County jail and Greg Nard in nearby Walker County.

With court dockets in Lauderdale County backed up, the wheels of justice turned slowly in the Wright case. In the ensuing months, forensics proved all three men were indeed inside Greg Wright's rural manufactured home; the blood found on the storm door and porch of Wright's home proved to be that of William Nard, who was injured in the struggle. Court appointed attorneys filed various motions, but in the end, all were denied, and prospects of the death penalty faced the three Iron City residents who had crossed the state line to commit the crime.

In an attempt to avoid death by lethal injection, Greg Leon Nard admitted to killing Wright and pleaded to the charge of capital murder with the promise of a sentence of life without the possibility of parole. William Nard, who had assisted his son in the actual murder, pleaded guilty to felony murder and robbery. He was sentenced to two consecutive terms of life with the possibility of parole. Such consecutive terms are highly unusual and are perhaps a de facto sentence of life without for the elder Nard who is almost 50 years old.

Ernest Widdowson pleaded guilty to felony murder, but was found to be innocent of charges of robbery in the theft of cash and a small stash of marijuana. Widdowson's testimony had backed up William Nard's in implicating Greg Nard as the actual assailant. Widdownson also freely admitted to assisting in holding Wright against his will, as well as not reporting the crime after returning to Iron City. For his part in the murder, on September 21, 2009, Judge Mike Jones sentenced Widdowson to twenty years in prison.

In all probability, Greg Wright would be alive if the Nards had not decided to spend their night drinking. In all probability, Ernest Widdowson would not have joined the Nards in their quest for the small sum of $70.00 if he too had not let alcohol cloud his judgment. Statistics show at least 80% of all violent crimes are fueled by the abuse of alcohol and other drugs. In this case, it cost Greg Wright his life.

Can't Get Enough Crime? She rushed to the front door of her 216 Signore Drive home in Russellville, Alabama, to find her neighbor Christie Scott. Scott, who lived at 180 Signore Drive, held her four-year old son Noah, while screaming hysterically that her house was on fire.

Davidson immediately called 911; the call reached the switchboard at 2:31 a.m. Firetrucks arrived at the burning residence within ten minutes, but it was almost five minutes more before Scott, 31, informed the firefighters that her six year-old son Mason was still trapped inside.

Scott indicated the location of Mason's bedroom, an area that was already totally engulfed in flames. The responders looked at the flames broaching the roof and windows and knew that little could be done to save the child from the inferno, yet they worked swiftly to quell the fire, and by 4:00 a.m. responders were able to enter the dwelling. Franklin County Coroner Elzie Malone pronounced Mason Scott dead at the scene.

Christie Michelle Bray Scott was too upset to answer the investigators' questions coherently, but they did learn that Noah Riley Scott had been sleeping in the bed with her while her older son, a victim of Asperger's Syndrome, slept at the other end of the house. Scott's husband Jeremy, 32, an executive with CB&S Bank, was away on business.

Russellville Fire Marshal Bobby Malone surveyed the charred refuse that had been the Scott's home. It was normal protocol to inform the Alabama Department of Human Resources when a child under the age of 18 died. He also decided to call in the State Fire Marshal; Christie Scott had been involved in five fires within the past eight years.

Three days after the death of Mason Scott, pieces of the puzzle that surrounded his last minutes were already falling into place. Russellville Fire Marshal Bobby Malone had called in the Russellville Police Department, the Alabama Fire Marshal's office, and the Bureau of Alcohol, Tobacco, and Firearms.

State Fire Marshal Ed Paulk utilized an accelerant-sniffing dog to determine that the fire was not accidental in nature, but ultimately stated only that the blaze had originated around six-year old Mason's bed. Could the mildly autistic child have been playing with chemicals that some how ignited? Could an arsonist have known that Jeremy Scott was out of town and used that opportunity to settle some real or imaginary score? The third scenario seemed even more bizarre to authorities: Christie Michelle Bray Scott had herself started the blaze that claimed the life of her older son.

It had been less than three years since a fire had destroyed the family's former home at 35 Steel Frame Road in Russellville. There were no injuries in that fire, and Christie had blamed a Glade air-freshener plug-in for the blaze, while investigators had theorized the fire had been intentionally set using cardboard boxes. There had been no physical injuries related to the previous fire, the second within two days; but the home had been insured, and both Christie and her father Don Bray were insurance agents.

The investigation into the previous two fires had been perfunctory at best and intentionally sabotaged at worst. No one wanted to listen to the investigator's theories of arson and pyromania. Christie was a native of nearby Haleyville, the daughter of Don and Kathy Bray, both leading citizens in the small town. Her husband Jeremy S. Scott was an Information Technology specialist for CB&S, a locally owned bank that had been a Russellville institution for over 100 years. Yet the fires on Steel Frame Road had raised suspicions among many in the community--Christie had been involved in two fires at her family home in Haleyville. Now a fifth fire had claimed not only the young couple's new home, but their child.

Mason had started the first grade at Russellville's West Elementary School on August 4. Less than two weeks later he was dead. Many who had observed Christie and Mason together characterized the mother as uncaring. Others in the community were surprised that Scott showed so little emotion during her son's funeral at Russellville's Calvary Baptist Church and in the days that followed.

Christie Scott returned to live with her parents in Haleyville, while her husband Jeremy took their younger son to his parents' home in Russellville. The young father also took out a protection from abuse order against his now estranged wife after Mason's autopsy showed large amounts of sedative in his system, but physicians admitted to prescribing at these dosages in order to calm the hyperactive child. On October 26, Franklin County Judge Terry Dempsey issued a warrant for Scott's arrest after her indictment by a grand jury. Information presented during the hearing indicated that Alfa Insurance agent Christie Scott had taken out an additional life insurance policy in the amount of $100,000.00 on her son the day before his death.

As Christie Scott turned herself in, Franklin County District Attorney Joey Rushing and Russellville Police Chief Chris Hargett held the obligatory news conference and photo op. The bearded Rushing reiterated the basic facts of the indictment--three alternative accounts of capital murder, after which the often beleaguered Hargett mumbled over the sadness of it all, failing to remember if Mason was in kindergarten or first grade.

In the nearby courtroom, Circuit Court Judge Terry Dempsey refused bond in the case, even though both Scott's father and husband, with whom she was now ostensibly reconciled, testified that the former Alfa representative was no flight risk. Adorned in an orange jumpsuit and handcuffs, Scott was returned to the Franklin County Jail where she remained.

Don Bray, a successful Woodmen of the World insurance agent in Winston County and self-proclaimed world's greatest chef, arranged for Huntsville defense attorney Robert Barry Tuten to represent his daughter. Tuten, a summa cum laude graduate of Jones School of Law, specializes in capital murder cases and has in the past represented such defendants as Natashay Ward, the Huntsville woman accused of starving her three children to death, as well as Andrew Pakhomov, the UAH physics professor tried for the murder of his wife.

Tuten also asked for a change of venue, another request denied by Judge Dempsey. Dempsey stated the jury pool for Scott's trial would be increased by 300, bringing the total to 500 individuals in hopes of selecting a fair and open-minded jury. Tuten announced the jury selection process might take as long as five days.

Franklin County is no stranger to murder cases in which a young child was the victim; however, this was perhaps the first case involving someone of Christie Michelle Bray Scott's socio-economic standing in the community. Her family's money and position bought her the best defense attorney; but it remained to be seen if such factors would influence jurors from provincial Franklin County after they saw the photos of Mason's charred body.

After a trial lasting two weeks, a Franklin County jury convicted Christie Bray Scott of three counts of capital murder. During the trial, the prosecution produced evidence of insurance fraud and an emotional affair with long-time family friend William Markham, a former insurance agent who agreed to hold personal items for Scott the day before the fire.

In his closing statements, Joey Rushing said convicted murderess Christie Michelle Bray Scott should die. Joey Rushing, as usual, said a lot of things. The Franklin County District Attorney was quoted in the TimesDaily as stating:

There's nothing worse than a mother murdering a child for insurance and because they didn't want him.

We're not sure to whom the word "they" refers. Observers said Christie couldn't handle the child. Friends said Jeremy was more interested in work and possessions than he was his own son. William Markam, the man who admitted on tape to being Christie's emotional lover said he didn't care for the child, a child he thought should have been "whooped" more.

Surely, these others in Mason Scott's life deserve some of the blame for his death. No, they didn't murder him, but they apparently made no attempt to intervene in what was obviously a pathological situation, a textbook dysfunctional family.

Joey Rushing requested that Judge Terry Dempsey sentence Christie Scott to death by lethal injection, an Old Testament eye for a eye. Surely spending the rest of her natural life in the hell hole that is Tutwiler Prison would have been enough punishment for this sick, sick woman. Despite the jury's recommendation of life in prison without the possibility of parole, on August 5, 2009, Judge Dempsey sentenced Scott to die by lethal injection.

Louise Harris from Montgomery, Tierra Gobble from Houston, Shonda Johnson from Walker, and Patricia Blackman from Houston--all prisoners at Tutwiler with a "Z" before their Alabama Inmate System Number, all women who expect to die in prison, all females sentenced to death for heinous crimes. Now, Christie Michelle Bray Scott of Franklin County will join them.

In less than 30 days, the State of Alabama will forward paperwork to the Franklin County Jail ordering deputies to transport Scott south to Elmore County, home of the Julia Tutwiler Prison for Women. In all probability, Scott's journey will take place at night. Unannounced, a female jailer will enter her cell, command her to dress, shackle her, and escort her to a waiting transport. Marked police vehicles are allowed to speed down the state's roadways, and Scott should reach Tutwiler shortly after dawn.

Most transfers are shuttled into a holding pen outside the prison, but a prisoner with a death sentence should be given special escort into the building. There Scott will be told to disrobe and shower. Prison workers will delouse Scott, a barber will cut her hair to collar length, and she will be handed a unisex white uniform along with a minimum of toiletries. Now Scott is ready to be taken to her new home--a small cell measuring approximately 10' x 10'.

There are only four death row cells at Tutwiler, currently all full. It's likely Scott will be placed in one of the adjacent segregation cells. It's also likely prison personnel will make it clear to Scott that she is a burden to them, since she is only adding to their time-consuming death row routine.

Now, Christie Scott is alone, alone with four books, a television if any of her family should desire to provide her one, and possibly a small animal. Yes, Scott will have the luxury of a bird or a cat, as long as her family provides its upkeep. She will also get to shower every other day and walk for one hour each day in a small private garden. Even her meals will be delivered to the small cell that will become her home.

For 30 days, Scott will be allowed no visitors. After that period, immediate family may make arrangements to visit during approved hours. Then Christie Scott will be alone again, alone in a cell where all lights are turned off at ten o'clock at night, alone with her thoughts and her guilt.

This is the life for which Christie Michelle Bray Scott traded her son Mason. Let us all pray for her family.

The preceding account was taken from Shoalanda Speaks columns published between June 6 and August 5, 2009. On August 7, 2009, Christie Michelle Bray Scott was transported to Julia Tutwiler Prison where she remains waiting an appeal.

The Keith McGuire Rape Case

"He stated he had a problem." - Limestone County Sheriff Mike Blakely speaking of Keith McGuire

We expect those in the teaching profession to care for our children as their own and we should expect no less. Unfortunately, this is not always the case. There is always the John Mark Karr or Debra Lafave. When any teacher takes a sexual interest in his or her student, we are just that more wary of them all, sometimes judging them wrongly.

How do we know the difference between an innocent touch and something more sinister? How can we judge the intent of a teacher we barely know? More importantly, what happens if we're wrong? When there's two, or perhaps three, sides to every story, how can we discern the truth from fiction?

Such is the case of Brian Keith McGuire, a Lauderdale County native, now free on bond of $125,000.00 and facing a 1st Degree Rape trial in December. The son of Bobby and Jo McGuire of Lexington, Keith attended Lexington School for 12 years. By all accounts he was an average student and better than average athlete. His parents had helped establish the Lexington Rescue Squad, and his mother was held in high esteem by the community. Bobby, the current mayor of the small Lauderdale County town, was a strong presence in both the town and his own home. Those familiar with the family generally acknowledged that the soft-spoken Jo deferred to her husband.

Keith, as his parents called him, also deferred to his father, but adolescence brought changes in the youth. Physically resembling his mother, Keith boasted a shock of red hair and an outgoing personality. Sometime after elementary school, Keith began to call himself Fox, a name that still follows him. Whether because of his auburn coloring or his fancied desirability to the opposite sex, Keith was well-pleased with this new persona. Many in the Lexington community describe him as the all-American boy, but others began to see a darker side as McGuire grew to manhood.

Graduating from Lexington High School in 1978, Keith McGuire seemed at loose ends. No longer the high school jock, he began a career as a barber, but was always dissatisfied away from the lime light of athletics. Ending one's education after high school was not unusual in the rural atmosphere of Lexington, but other things about McGuire troubled some in the small town. Still others saw nothing wrong with boys being boys or sewing a few wild oats.

In the autumn of 1992, McGuire returned to college at Athens State University, receiving his teaching degree two years later. Now married to a young woman from a well-respected Waynesboro, Tennessee, family, McGuire used family influence to secure a coaching job at Clements High School, just across the county line in Limestone. Here Keith McGuire taught Physical Education, but some students began to report that his style of teaching was just too physical, especially where young women were concerned.

It was early in 2002 when Robin Greene’s 12 year-old daughter came to her with a story of being touched by her physical education teacher. Coach McGuire had touched her breast while they were playing one-on-one basketball and she knew it wasn’t right. Soon a 16 year-old girl came forward with a similar story concerning the Clements coach.

Clements, a rural school in western Limestone County, was a tight knit institution. Such things didn’t happen at the sprawling school where Keith McGuire had access to girls in the 7th through 12th grades. The school board called a special meeting and convened behind closed doors on March 7, 2002, to accept McGuire’s resignation.

The board stressed that McGuire, who had not retained an attorney, had taken a polygraph with inconclusive results. No charges were filed against the teacher even though according to Sheriff Mike Blakely, McGuire stated that he had “a problem.” The board also agreed to take no further action on the Clements coach’s teaching license on the condition he agree to counseling. Keith McGuire attended one session.

McGuire soon returned to the hamlet of Lexington where his father was a member of the town council. The town’s water department was in need of a meter reader, and Bobby McGuire made sure the job was offered to his son. Keith McGuire’s salary at the financially strapped water department was barely enough to meet his basic needs, and he began searching for another teaching position.

Without any official black marks on his record and a still valid teaching license, McGuire found work in the nearby Haleyville school system. He began coaching at the Winston County school in September 2002, but the problem of his mounting debts remained. Not eager to give up his job with the town of Lexington, but unable to fulfill his obligations on his free weekends, he sought an assistant to help with meter reading and related duties. Soon his friend Lloyd Hayes, a former Florence City Fire Marshal and convicted sex offender, joined McGuire in the field. It wasn’t long before residents realized the two men spent an inordinate amount of time working around one local entity--Lexington High School.

When board members of the Lexington Water Department heard of the job sharing agreement between Keith McGuire and Lloyd Hayes, they too met behind closed doors. Even though Hayes was not an official employee of the town, such an arrangement was ill advised. McGuire gave up his job with the town, but once again many questioned his actions. Was Keith McGuire determined to insinuate himself into a position of familiarity with young girls, or just a man attempting to make a living during a difficult period in his life?

McGuire taught at Haleyville High School for two years, with ostensibly no complaints. In the fall of 2004, McGuire moved to J. F. Shields High School in Beatrice, a small Monroe County town in South Alabama. After a year at Shields, McGuire moved again, this time to Jackson High School in Clarke County, even farther from his Lexington home. By this time, McGuire was divorced from his wife Tammy, who had taken their children and moved to Waynesboro. While it’s not unusual for some coaches to move frequently, many found it odd that each relocation moved McGuire farther from his family.

McGuire publicly blamed any problems on Robin Greene of Limestone County. After the physical education teacher left Clements High School without any official sanctions, Mrs. Greene took it upon herself to warn Keith McGuire’s new employers of his past record. According to Mrs. Greene, she had collected the names of 50 students at various schools, all alleging to have been molested in some manner by McGuire. On February 14, 2006, McGuire filed a slander suit against Robin Greene, claiming her campaign to discredit him had hurt his reputation and brought undue hardship on him. The wheels of justice grind slowly, and this suit is still pending in Limestone County; however, McGuire also initiated a restraining order against Mrs. Greene, preventing her from contact with any school at which he is employed.

With the Clements charges now seemingly behind him, Keith McGuire began to make a reputation for himself at Jackson High School--this time a good one. Besides his duties as assistant coach, McGuire taught Physical Education, Drivers’ Education, and Health. In the autumn of 2006, the National All-Star Football Association chose McGuire to coach a regional game in Cookville, Tennessee.

Keith McGuire was finally receiving the kind of success and attention he thought he deserved. Then a Shoals area woman filed rape charges.

In 1990, Jan Simpson* was 19 years old. According to Simpson, Keith McGuire raped and sodomized her at a Florence residence--it took 16 years before Simpson was emotionally able to report the crime. McGuire, who would have been 30 at the time of the incident, steadfastly denied that any force was involved in his encounter with Simpson. Allegations that a 30 year-old McGuire had sexual relations with a teenager obviously did nothing to bolster his claims of having no prurient interest in pubescent girls, and Jackson High School declined to renew his teaching contract.

The rape allegation was not McGuire’s only worry; at this time new reports of McGuire’s misconduct with Clements students surfaced, making their way to the Alabama Board of Education in Montgomery. The Board sought the revocation of Keith McGuire’s teaching license, and an inquiry was held at Clements on June 25, 2008. The Board stated that McGuire was guilty of “immoral conduct or unbecoming or indecent behavior.”

After five hours of testimony, including statements from some who had only recently come forward, the hearing ended. The moderator then had 30 days in which to consider the evidence brought forward; however, McGuire now had more serious problems in Lauderdale County. After a police investigation spanning almost two years, a Lauderdale grand jury indicted the former physical education teacher on charges of 1st degree rape, 1st degree sodomy, and 3rd degree sexual abuse, crimes that carry a mandatory sentence of 20 years to life. McGuire turned himself in to the Lauderdale County Detention Center on August 18. His bond was set at $125,000.00. The Clements charges were then placed on hold until after the criminal proceedings.

Knowing in advance that his bail would be substantial, the ex-teacher’s family had made prior arrangements, and McGuire left the detention center the same day. McGuire’s family in Lexington had also hired Florence criminal defense attorney Jeff Austin to defend the charges. Austin had previously represented Trey Wells, the Tuscumbia youth charged with the brutal deaths of both parents, and Dewon Jones who took part in a heinous liquor store robbery and murder. The attorney announced he was prepared to present a staunch defense of his client and was seeking an immediate trial.

Unfortunately, the McGuire family’s participation in the rescue squad and other Lexington civic endeavors had made them known to Lauderdale County judges, and the trial was moved back until a new jurist could be engaged. A trial date was set for the second week in December, with Judge Terry Dempsey of Franklin County presiding and Assistant State Attorney General Pamela Casey prosecuting the rape charges.

Pretrial/Status Call was to begin December 2; at that time McGuire could assert his innocence and the trial would proceed the next week, or he could accept a plea and be immediately sentenced and remanded to the Detention Center to await transfer to Kilby Prison in Montgomery for processing. For whatever reason, Jeff Austin, who had filed copious motions, requested a delay, and the pretrial was rescheduled for December 22. Legal machinations are often unfathomable to the lay person, but in this case it would seem the intent is to allow Keith McGuire to spend one last Christmas as a free man.

Such delays are always hard on the victim, but Jan Simpson has used her time to act as an advocate for other victims of sex crimes. One can only imagine how Keith McGuire has spent his days since his dismissal at Jackson High School, but his Classmates’ profile is revealing. In the popular website, he states he’s there to find Ms. Right and lists his principal occupation as “channel surfing.”

May justice be served, the guilty punished, and the innocent vindicated.

*****

On July 29, 2009, a jury of six men and women, after deliberating over a period of three days, returned a "not guilty" verdict in the rape and sodomy trial of Brian Keith McGuire. It is doubtful the victim will initiate any civil proceedings against McGuire, who has not worked as a teacher in over a year.

The victim is hardly a total loser in the proceedings. Testimony in the trial revealed that McGuire had been diagnosed with an STD at least two years before his unprotected sexual encounter with the young woman and that during his divorce proceedings he initiated DNA testing on his children. Such tests proved him not to be the biological parent of the older child, perhaps one reason the Lexington native has distanced himself from his family over recent years.

However, McGuire still faces the loss of his teaching license due to allegations he fondled at least four students while teaching at Clements School in Limestone County. Robin Greene of Athens has stated she has the names of at least 50 young women McGuire has sexually touched over his teaching career. The former teacher is suing Greene for slander.

Within the next few days or weeks, Chief Administrative Law Judge Walter Turner will announce his ruling in the license hearing of Brian Keith McGuire. It's a verdict for which many have waited years and one in which we should all be interested. Our children deserve a good education. While we may not be able to provide the best educators in every classroom in the state, we should be able to provide those who have their students' best interests at heart. It's time Alabama made an effort to ensure that.

* The victim’s name has been changed for the purposes of this account. This account taken from columns originally published November 29-December 2, 2008, and July 29, 2009.

Murder in Lexington - The Shaun Shapley Story

The following article is taken from columns originally published November 14-16, 2008, and February 15, 2009.

"I couldn't think of a better place to raise children. We have no crime in this town." - Clint Freeman

When Jennifer Helen Bragg and her family moved to Lexington, Alabama, friends say she finally felt she had found a home. On the night of February 7, 2008, 17 year-old Jennifer died at ECM Hospital, ostensibly the victim of her stepfather, Shaun Clovis Shapley. The 44 year-old Shapley is currently being held on $500,000.00 bond in the Lauderdale County Detention Center; his trial is scheduled for February 9, 2009. At his arraignment November 13th, Shapley pleaded not guilty.

Shaun Clovis Shapley, sometimes referred to as Shaun Glouis, was no stranger to the judicial system. Before moving to Alabama, Shapley lived in the Polk/Hardee County metropolitan area of Florida. The oft-married Shapley was regularly in court as both defendant and plaintiff.

While still living in Florida, Shapley had been in prison three times for various crimes including felony assault, the victims usually women. On the night of May 8, 2000, Shapley was intoxicated and began to follow a black couple who managed to contact police. Having been informed that the pair was being pursued by "a crazy man," police gave chase and attempted to arrest Shapley when he pulled into a parking lot. Shapley, whose pickup was adorned with Confederate symbols, told arresting officers that he was chasing his girlfriend and another man.

Doubtful of his story, officers attempted to arrest the obviously intoxicated Shapley, who resisted. Shapley, already married to Jennifer's mother, claimed numerous violations of his civil rights and sued the arresting Polk County officers. A judge subsequently dismissed the suit as frivolous.

The next year Shapley brought suit against the State of Florida for violations of his civil rights in conjunction with several child support cases that had been filed against him. He included ex-wife Kathleen White of Winterhaven, Florida, in the suit for sixty-four million dollars. This suit was also dismissed, and Shapley told sources at the local NewsChief that his record had worked against him. The Polk County paper stated at that time, "Shapley admits he has married his own cousins in the past."

In late 2001, Shapley and Jennifer's mother Kimberly left Florida for Huntsville, Alabama, where they hoped to find jobs. After more arrests in Huntsville, the Shapleys decided to move again, this time to Florence, where they found Section Eight housing. Mary Kennedy, director of the Section Eight program for the Florence Housing Authority has declined to discuss the reasons for the Shapley family's eviction, but Shaun Shapley again saw an opportunity for some quick cash and filed suit for two million dollars against the Authority and HUD. This suit was also dismissed as frivolous, leaving the family broke and looking for a place to stay. They soon found a new home in Lexington, Alabama.

Lexington sits in the northeast corner of Lauderdale County. A town of less than 800 citizens, the rural community boasts only four residents describing themselves as non-Caucasians, none of them black. For someone like Shaun Shapley, Lexington must have appeared the perfect community. Older residents have no trouble remembering when outsiders made sure they left the town before sundown, but Shapley's good ol' boy persona ensured him a measure of acceptance.

The family rented a small home on County Road 51, just two miles southeast of the building that houses both the Lexington Town Hall and the Police Department. Two blocks to the east of Town Hall sits Lexington High School where Jennifer enrolled and quickly made friends. Both Jennifer's classmates and teachers relate that she did well and was enrolled in the Upward Bound Program, requiring her to take classes at Shoals Community College in Muscle Shoals. Lexington Principal Will Joiner commented that Jennifer knew where she wanted to go and was determined to make her dreams come true.

If her days in school were full and rewarding, her home life was less so. One of three children, Jennifer had been forced to move often, first with her mother Kimberly and then with Shaun Shapley after her mother's marriage. Her father's family had lost track of the three youths, only learning of their whereabouts after Jennifer's murder. Jennifer's older brother had joined the military to escape life with Shapley, but her older sister remained in the household. At age 19, the sister was the unmarried mother of two small children, a situation that had already garnered much community speculation. Only days before her death, Jennifer had told friends at Lexington High School that she had made plans to leave her home, but not before she reported her stepfather's unwanted advances to the proper authorities.

On the night of February 7, 2008, while her classmates were enjoying time with family and making plans for the upcoming Valentine's holiday parties, Jennifer Bragg found herself alone with her stepfather in the master bedroom. Shaun Shapley is the only living individual who has knowledge of the events that took place in that bedroom, but the vibrant, healthy teenage girl who walked into that bedroom left it on a gurney, her trachea collapsed and her hand and stomach bleeding from the gunshot of a .44 calibre weapon. Jennifer Bragg died at ECM Hospital later that night.

When paramedics arrived at the Shapley home on County Road 51, they found Jennifer Bragg lying across the bed in the master bedroom, a gun nearby. Shaun Shapley told of Jennifer's intention to commit suicide and how he had valiantly tried to stop her. When later questioned, Kimberly Shapley admitted to being in a nearby room, unaware of the events that claimed her daughter's life, but insistent on the kind of father Shaun had been to her children.

Upon arrival at ECM Hospital, Jennifer was pronounced dead. Both paramedics and medical personnel at the hospital noted that the gunshot had blown off two of Jennifer's fingers--an unusual wound in a suicide. When Lauderdale County District Attorney Chris Connolly became aware of the odd circumstances in Jennifer's death he ordered an autopsy. The results of the post mortem indicated Jennifer died by manual strangulation, not a gun shot wound. Lauderdale County Deputies arrested Shaun Shapley on Monday, February 11th.

Held in the Lauderdale County Detention Center on $500,000.00 bail, Shaun Shapley vehemently denied any part in Jennifer's death. Kimberly Shapley stood by her man, requesting he be allowed to attend Jennifer's funeral and listing him as Jennifer's father in the obituaries. Jennifer was buried on Wednesday, February 13th. Two days later Kimberly arrived at Lexington High School to clean out her daughter's locker. Refusing any help, Kimberly Shapley boxed up her daughter's possessions and carted them away without letting anyone else view her daughter's personal effects.

A judge appointed attorney Joseph Daniel to defend Shapley, who was found to be indigent by the court. Unhappy with Daniel, Kimberly Shapley, who had requested funds for funeral expenses in Jennifer's obituary, began selling her possessions in order to retain another attorney. Kimberly Shapley soon contacted Jim Stansell of Rogersville, an attorney known for frequently defending those accused of sex crimes.

For whatever reason, Shapley was not arraigned until November 13th. Stansell spoke for his client and proclaimed him "not guilty." Judge Mike Jones scheduled Shapley's trial for February 9, 2009--a year and two days after Jennifer's murder. As Shaun Shapley left the courtroom in his regulation green jumpsuit he turned to blow kisses at Kimberly Shapley who had come to support him. No one was present on Jennifer Helen Bragg's behalf.

* * * * *

One would expect any judge to be criticized no matter the nature of his rulings; however, Judge Jones has recently been raked over the legal coals for accepting a plea bargain in the Shaun Shapley case.Shapley, a resident of the small town of Lexington, murdered his 17 year-old stepdaughter in 2008. The murder ostensibly occurred during an attempted rape. DNA testing proved Shapley to be the father of two children belonging to the victim's older sister. Previously, Shapley had been charged with violence against women in his home state of Florida and his former residence of Huntsville, Alabama.

A murder committed during the commission of another crime is categorized as a capital offense--in other words, Shapley at the very least should have been subject to life in prison without the possibility of parole. Instead, Judge Mike Jones sentenced the convicted felon to a term of 25 years. A Class A felony, this conviction will allow Shapley to be eligible for parole after 15 years. Obviously many in Lauderdale County and the entire Shoals area have been outraged by this sentence.

The Christopher Stanback Murder

The following is from a series of articles originally published November 24th & 25th, 2008:

Chris Stanback's MySpace profile lists his age as 31, but his photograph is that of a 17 year-old boy, the age at which the Colbert County teenager died. The accompanying short bio prominently features the $20,000.00 reward for information leading to an arrest in the case, evidence of the desperation haunting the Stanback family for the past 14 years.

The summer of 1994, Christopher Stanback, known to his friends as Chris, returned from his home in Idaho to spend the summer with his mother Teresa, brother Harold, and sister Tara. On August 2, 1994, Teresa Stanback reported her son missing. Four days later, two children playing in a wooded area near the Carver Heights housing project found a body.

Speculation that the body was Chris' spread throughout the West Florence neighborhood, and soon a crowd of over one hundred spectators had gathered to watch Florence Police retrieve the remains. Many in the crowd of predominately young males tossed rocks and bottles at the authorities as they tried to move the body without disturbing any forensic evidence. Helicopters hovered overhead, their presence having no discernible effect on the crowd that was rapidly growing into a mob.

It had been less than three months since Florence Police officers had conducted a nighttime raid on the black neighborhood, arresting numerous drug dealers in what then Florence Police Chief Rick Thompson had dubbed Operation Copy Cat. To most of the gathering mob, Chris Stanback's death was just more proof that the police couldn't be trusted.

Fortunately, local black leaders managed to control the growing crowd when authorities couldn't. Once the barrage of rock and bottle missiles halted, police retrieved the body and secured the scene. Those who saw Chris Stanback's body realized that more than four days of summer sun had left an imprint on the murdered youth. What an autopsy later determined to be the results of a combination of beating and mutilation, the police took to be evidence that the body had been burned before it was disposed of.

While their initial finding may have been easily explained under the circumstances, it only served to enforce the black community's opinion of the Florence Police Department: Truth was the last thing on their minds.

Results of the initial autopsy indicated Chris Stanback had died of head trauma, but offered few clues as to the murderer. Many speculated that the mutilation included castration, making it a very personal crime. Chris' brother Harold, nicknamed Rudy, was a known drug dealer. The two brothers bore more than a slight resemblance to each other; was it a case of mistaken identity?

Just two weeks before his death, Chris had been apprehended in Cullman with a group of older drug dealers. Since Chris had refused to claim the confiscated drugs, was his murder in retaliation?

Perhaps the most bizarre rumor concerned the involvement of prominent Florence officials. It had been widely reported that Chris was dating the daughter of a high ranking city employee. Everyone close to the situation knew this single father had expressed grave concerns about the relationship. Had this official recruited police chief Rick Thompson to help him dispose of the problem?

Weeks turned into months, and there was still no answer to the mystery of Chris' death. Various local officials offered a $10,000.00 reward in the case, and Chris' uncle promised a matching amount if anyone could help solve the crime. Eventually local police asked the FBI to investigate, calling it a possible hate crime. Years passed, and officials were still no closer to an answer.

The Stanback family remained determined to bring the murderer to justice. Hearing that Chris' age classified the crime as a child murder, they asked the Center for Missing and Exploited Children to enter the case. In April 2003, Chris Stanback's body was exhumed for a second autopsy, but the results offered no new evidence. Several Florence police officers took polygraph tests at this time; all of them passed. The investigation was back to square one.

Currently, the Alabama Bureau of Investigation is in charge of the Stanback murder, considering it one of their top priorities. Teresa Stanback still places reward posters around the area and hopes that someone will come forward after fourteen years. She laments that her son's grave has been repeatedly vandalized. Some days it's hard for her to find the strength to go on, but she has never given up hope.

This case has often been compared to that of Emmitt Till, the young black man murdered in 1950s Mississippi. Emmitt's murderers were eventually found; let's hope Chris' are too.

1965 Nenon Murder

As we stated earlier, while we will be reprinting popular crime columns from Shoalanda Speaks, we will also be featuring articles on older crimes of interest to the Shoals area.

If anyone has memories or newspaper clippings concerning the death of a 22 year-old man who was shot and killed at a high school sorority party on Lake Wilson in the summer of 1965, please contact us at shoalanda.speaks@gmail.com.

We also welcome suggestions for further crime columns.

Roger Lovelace, Flogas, & the Law

The following is from a series of articles originally published January 5-8, 2009:

Retired Florence Gas Department manager Roger Lovelace was arrested Sunday for impersonating a Florence police officer. According to his defense attorney, Tim Case, Lovelace was released from the Florence-Lauderdale County Detention Center after posting a $1,000.00 bond.

Lovelace is 62 years old, lives in the exclusive Indian Springs community, and now works for the Brinks Security Company. What would compel a man in his position to commit a felony of this nature? Perhaps his previous life may offer some answers.

Roger Lovelace was reared in the North Florence neighborhood of Dulin Heights and attended Florence City Schools. Whether because of academic problems or other issues, Lovelace fell behind, graduating from Coffee High School in the late 1960s. Friends report that the he was an inveterate prankster and constant fixture on what was then known as "The Strip," a short access road running between Cherry Hill Homes and the old Florence K-Mart.

After graduation, Lovelace joined his half-brother Doyle in the natural gas industry. Doyle Lovelace worked for many years in the now defunct Alabama-Tennessee Natural Gas Company, while Roger toiled at the Florence Gas Department, commonly called FloGas.

Perhaps Lovelace would have been relegated to field work his entire career, but in the early 1980s, technology gave the future gas department manager a break. It seems that Roger Lovelace was a computer whiz.

When the natural gas industry began using computer technology in metering stations and gas accounting, Lovelace was in his element. He quickly rose to the position of assistant manager under Gas Department Manager Jack Hilliard. Many who knew the assistant manager were surprised at his sudden rise in the department, but thanks in part to Hilliard's own success, Roger Lovelace still had places to go.

When Jack Hilliard had taken over the management of the Florence Gas Department, it was considered something of a poor relation to the Electricity Department. Until Alabama-Tennessee Natural Gas completed its pipeline in the early 1950s, heating with gas was a rarity in this area. Hilliard was credited with almost singlehandedly making FloGas what it was in the early 1990s, a fact not lost on Florence Mayor Eddie Frost.

It was no secret that Frost wished to combine the management of the Electric, Gas, and Water Departments when the long-time electric manager retired. He felt that Hilliard could do for the other two entities what he had done for natural gas. There was wide speculation as to who would fill Hilliard's Gas Manager shoes when he stepped into the new position of Utilities General Manager. Very few had their money on Roger D. Lovelace who was not known for either his people or managerial skills. When the city announced Lovelace's appointment as Jack Hilliard's successor, a long-time Alabama-Tennessee Natural Gas manager was heard to have said, "He knows where the bodies are buried."

Lovelace took over the management of FloGas in 1993 and by 1995 was lobbying for its own Internet Provider Service. Florence needed a computer service, and Lovelace convinced the City Council that he could provide the needed services at a much cheaper rate than America On Line, the leading contender. When the completed ISP was in place, Lovelace dubbed it FloWeb and named himself the webmaster, a position separate from his duties as gas manager and one that offered a second substantial salary.

Elected officials were initially pleased with Lovelace's work and the money he was saving the city. After a few years of municipal use, Lovelace then proposed offering FloWeb to the citizens of Florence, and by 2000, the city became one of only three governmental entities offering Internet Service to the private sector. Lovelace then initiated an elaborate website featuring FloGas' private weather station, prominently showcasing the company's offices on Rickwood Road.

Despite Lovelace's lack of diplomacy or humility, it seems he was heading in the same direction as his mentor Jack Hilliard. Then Roger Lovelace's tower of Internet power began to tumble.

If Florence officials were initially happy with Roger Lovelace's FloWeb, many others were not. One local businessman, hoping to start an ISP in the private sector, went as far as retaining hotshot Florence attorney Marshall Gardner to sue the city over its intrusion into the private sector. The businessman decided to drop the lawsuit, but others were still skittish about FloGas' foray into the still-new realm of the Internet.

Rising costs of running FloWeb, few private subscribers, and a missing $215,000.00 Cisco router signalled the death of Roger Lovelace's pet project, but the Florence gas manager's troubles were just beginning. After losing almost a half million dollars in the FloWeb debacle, it was learned that he failed to lock in low natural gas prices during this period. Lovelace blamed subordinates, but did admit that he had not kept track of the overall workings at FloGas while he had been absorbed with the now defunct FloWeb.

Apparently, Roger Lovelace had not kept track of other matters as well, failing to take a $128,776.83 discount on a construction project. When auditors began to delve into the financial machinations of Florence's gas utility, they soon discovered that the company benefiting from Lovelace's oversight was Golden Construction, a company owned by Ronnie Golden, Lovelace's brother-in-law and brother to Donnie Golden, a former member of the infamous Colbert County Dawson gang.

Many Florence residents were enraged by the manager's actions during a period of rising natural gas prices and complained to city officials, who began a deeper investigation into Roger Lovelace's financial dealings. Having been shocked by the initial reports of the gas manager's haphazard business dealings, they were now dumbfounded by the emerging new revelations.

One has to wonder if Lovelace saw the demise of a public FloWeb as the beginning of the end of his career at FloGas. In all probability, he did not. His immediate superior was still Jack Hilliard and, earlier in his career, he had survived rumors that he had helped his son hack into Pentagon computers. Lovelace continued his rush to an FBI investigation that is still ongoing.

Contending that replacement pipe for the FloGas system did not fall under bid laws, he purchased large amounts from at least two companies at inflated prices. The Florence system was not expanding, a fact that produced dismay in several newer subdivisions, including Heritage Village to the north of Florence. Why the need for so much pipe? An official inventory found enough stockpiled replacement pipe to reach to Birmingham and back.

Lovelace also was known to use gas department labor at his home and continued to use his brother-in-law's construction company, not bothering to request official change orders to existing purchase and construction contracts. In all, over $420,000.00 additional work was given to Ronnie Golden's construction company without proper approval. To add further insult, Lovelace authorized the loan of FloGas equipment to Golden Construction, including phone lines.

Whether one is a Scott Carrier fan or not, the late Florence Councilman, along with a handful of other concerned private citizens, succeeded in bringing Lovelace's malfeasance to light. By now, Bobby Irons was mayor, and while he was reported to be no fan of the corrupt gas department manager, neither was he anxious to fire the department head.

For almost two years, Roger Lovelace remained on FloGas payroll, finally retiring in 2006. When Jack Hilliard also retired, Mayor Irons eliminated the position of General Utilities Manager and combined the Gas and Water Departments under Mike Doyle, who has managed to keep a low profile during his stint at the helm.

Roger Lovelace then went to work for the Brinks Security Company where he planned to work until retiring at the age of 70. While already drawing a substantial retirement from the city, Lovelace should have been in a position to offer his expertise to charities and other social causes, thus insuring a more inspiring legacy. Now it seems we will be filing Roger D. Lovelace's latest chapter under notoriety, and the FBI has yet to weigh in with its official report.

Visitors to the Florence Municipal Building may have noticed changes in recent months. Where a photograph of Roger Lovelace used to grace the wall, now hangs a poster of a colorful Dalmatian--a sad commentary indeed.

She Said, "Murder!"

Since October 2008, Shoalanda Speaks has been bringing the Shoals area a daily column. While primarily a political blog, Shoalanda has also published news of charity events, local arts, and, of course, crime. It has been the articles on local crime that have by far drawn the most readers, indicating a need for more reports on the darker side of the Shoals.

While not all of our chronicles will be about murder, that crime will certainly play a large role in future articles in this new blog.
